Timeline

Hi VJers,

My mom sent me her I-134 form to be our co-sponsor, along with her tax transcripts, employer letter, etc. (Honduras requires 1040, W2s, employer letter). The thing is that my parents have not filed for their 2011 taxes yet, but they filed an extension. So my mom sent me a copy of the extension application but not any W2s (obviously she does not have the 1040 as she has not filed the taxes). She sent her 2010 information as well (including 1040 and W2s). Do you think the embassy will be picky about not having the W2s? (Honduras people might know better, I know... but just wondering) My mom makes above the poverty limit, I've already checked and double checked. I'm just worried about not having the W2s for 2011. I don't have any either but that's because I'm working overseas, but I do have my 2011 tax information.

When tax returns are requested as support for the I-134, the current or most recent one is generally most important. Like you said though, Honduras members might be able to help you better on the strictness of their requirements. However, I can't imagine it holding too much weight if everything else shows what her current income is. The most important part is proving one's current income. Tax returns are only supportive in showing stable income over time.

Yeah but my mom hasn't filed her 2011 taxes yet. I can't force her, she always files an application for extension (she's a very busy woman). I searched before here on VJ about it and someone said it was okay to show a copy of the application for extension. What I'm really worried about is the W2s that I don't have. I would email the Honduras embassy but no one answers emails or calls! Bah.

The extension letter along with a copy of her W2 ought to be enough. Also, she would send you an employer letter and copies of recent paystubs to prove current income.

If she is self employed, then the most recent year's tax return is required as the income number is found on line 22 of the 1040 tax form.

You should get her to send you a copy of her W-2 from 2011 to go along with the extension letter. However, if the extension letter from the IRS lists her individual income on it, and she has a letter from her employer and recent pay stub(s) to show current income, then you might be ok without the W-2. If at all possible though, I would also get the 2011 W-2 from her.

Yes, pay stubs are not required, and won't be a requirement for the I-864 later when filing for AOS either. They are just a good way to show current income. An employment letter that lists salary works too. Good luck!
