I also think it was a mistake.... they're only human at the USCIS office.

The infopass officers have always been very helpful to me....I'd definitely go and see them!

Old and Grumpy....But an American Citizen!!!

That's what the rejection letter said but the OP said he applied based on the 5-year rule, so not 319(a). Anyway, sounds like an obvious mistake. An Infopass is definitely in order.

As I understand the denial is because I filed about 6 weeks before 5 years of residency.

I was told that I can file 3 months before the 5 years, don't I ?!?!.

I don't understand why they assumed that I applied based on marriage, any way their explanation is…..

"You divorced ------ before you naturalized therefore you are not eligible for 319(a).

When you filed your N-400 you didn't have 5 years of permanent residency."

Married – 07/08/05

Permanent Residency – 02/03/06

Divorced - 12/17/08

N-400 – 12/20/10

Denial – 07/26/12

Now they invite me to reapply since I have 5 years and I can also request a hearing.

Any suggestions??

What's worse? A denied application or a misplaced application, latter happened to us on three different occasions.

Looking at the time line, green card was issued 7 months after marriage, infers a conditional two year green card. Divorced 10 months after supposed issuance of the ten year card. Bet this has something to do with the denial, but seems this should be determined at the interview, not by some guy making judgments reading the application. Could be justifiable reasons for the divorce and perhaps should be explained with the application.

Whole purpose of issuing a conditional green card is to assure you just didn't use marriage to come here. While a ton of proof is required for the three year, but not the five year, your marriage history is still explored even with the five year.

Deadline to register to vote is Oct. 9 so you won't be eligible to vote - but that's probably the least of your worries! Glad you got everything sorted!

I encountered the same problem when I applied for N400 based on marriage last April. I did an INFOPASS appointment in my local USCIS office and 3 officers looked at my application and they all agreed that they cannot find anything wrong with it. So I ended up returning my application with the green sheet that they provided to me which did not really help my case at all as you can see in my timeline. Registering to vote depends on your state. In MN you can register on election day at your polling place, so you should check your local laws.

Congratulations! I'm glad you got that straightened out. I hope you are able to register in time to vote, but that will depend on what your state rules. Here in Georgia the cutoff date is October 9th.
