Help with Tourist Visa

I am visiting the USA first, and if all is well then i will want to go back and stay, im going over for my first visit in a few months on a tourist visa o see what the usa is like, and if i enjoy it ect, then yes i will want to stay, so if i like it ect i can come back & apply for this Immagrint visa? from what i seen it takes up to 5months to get?

I am getting a return ticket back to ireland.

If i visit the US on a tourist visa this first time everything will be fine and when i come back i can apply for this Immagrint Visa, Correct?

I think you are confused. YOU cannot petition for an immigrant visa, you need an immediate relative to do so on your behalf. You cannot simply 'stay'.

Immigrant visas can take anything from 5 months to 23 years to approve, depending on what type you get. You need someone- a relative or employer- to sponsor you. Who will do that?

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

If i wanted to stay in the USA i want to do it Legally and the proper way, ok? I called the US embassy they said for a trip to the states for me the best isa to get is a 90day tourist visa and theyll grant me however many days over there. they stamp it twice. here & there..

Ive also been told that when i go there on that visa i can extend my time and stay a little longer before returning home. ok?

I am not going to stay in the usa on a tourist visa i will return home, but ive been told also that when i get there i can apply for a immagrint visa, and nothing was said about sponsorship ect.. do you guys have to be so blunt about it?? im doing it the proper way that chick from ireland has most likely married her way into the country. so please no rude comments.

Tourist/visiting implies a short duration and a return home. US immigration isn't set up for a come and hang out for a while with the boyfriend/girlfriend type of visa. Every person seeking entry is assumed to have immigrant intent. You may need to show proof of ties to home (school, job, property) to the US CBP officer.

When you pass through US customs (CBP) they will stamp your passport and give you a date that you visit ends. It's up to the agent how long a stay you will be granted. If you're leaving from Ireland, you will go through US customs at the airport there.

You can apply to extend you stay once you arrive in the US. Do some searching on the USCIS website for the procedure.

A Visa gets you into the US, if you are there you do not need one.

Also interested in which Immigrant Visa you consider appropriate.

It appears this is your first time traveling anywhere, as you say you are getting your passport. It is hard to know where to start, in how to explain international travel.

I assure you "that irish chick" did everything very properly as well.

Yes, you can go for up to 90 days in the US. Then you must go home. You run the risk of overstaying and not being able to return on the VWP if you violate it.

You still haven't indicated how you intend to get an immigrant visa, if you'd like you tell us your plan, we'd be happy to point you in the right direction, help you fill out the paperwork, and answer your questions.

However, you seem set on what you've been 'told'. If that is the case, why even bother coming on here to ask for advice?

Hey, its ok i got it all sorted now! i have called the US embassy of Ireland and they said i dont need a tourist visa (even though they told me i do??)

anyways, they said to fill out the VWP online at the embassys site to see if i pass and if i pass then i can travel to the US visa free, correct?? lol

Well i passed it and all i need to do know is get my ETSA referrence number thing which ill be paying the fee/printing it off soon before i leave..

i understand it all more clearly now, with the up to 90 days stay ect.. and how only a border patrol officer can grant me so many days to stay

But i was hoping i could stay just under 3months.. i was planning my leave mid october and my return on early january, i just hope they give me upto 90days when i enter the US because i cant afford to purchase a earlier plane and id like to stay over Christmas with family & friends :D i seen though that,that may sound scary but its very rare for them to turn you down? when you get there lol, and no i have flew before, just not on my own, im 19 and this will be my first trip to the USA/on my own so i am nervous and wanna make sure everything is fully legal and safe before going! :D

Anyways, got it all sorted out >.> and everythings fine now, Thnx to all for help! :P

...I dont know what visas i have to apply for to stay?? does the VWP let me stay? (i doubt it) bu just making sure lol

The VIsa Waiver Program (VWP) allows you to travel to the US without a visa. You get to visit for up to 90 days. Extending your visit is not allowed on the VWP. You must leave by your 90th day. If you are in the US on day 91, you will not be allowed to use it again and you would need a visa to visit the US.

Once again, ther is no legal way for you to remain and live in the US. Pretty sure there are billions of people who would like to come live here. Without a close family member (US citizen parent or US citizen spouse) or US employer who can sponsor you, you have no means to legally live in the US.
