Hi, my wife cancelled my immigration for CR - 1 visa application and now she wants to re - apply. Can anyone help me know the process please??? im so stuck

How long ago did she "cancel" the application......if you guys never received the NOA2 (approval) for the petition, then you may have to start over, as in filing everything all over again. Familiarize yourself with this guide, if that is the case http://www.visajourney.com/content/i130guide1

Give a little more detail in your situation and more people will be able to weigh in on what takes place after a cancellation.

I got my interview done. everything was in place. then suddenly 1 week after my interview, she cancelled everything. she said we are getting separated. and now she wants to re - apply..

I'm sorry, but I am confused.......were you issued a visa after your interview? Were you approved for the visa?

no, i didn't get visa issued...infact i had interview for the visa approval....I'll tell u what happened....i married an american citizen. she processed my papers for CR - 1. as soon as all the documentation was complete and interview fee was paid, i got call for interview. Wehn i went for interview, they said that i'll have to wait for 6 weeks for AP(administrative processing) and during that time, my wife cancelled everything, saying that we are getting separated...

Yes, she can re-petition you and pay all the fees etc. What I am unclear about is whether the approved I-130 can be re-used; I don;t think so though.

You'll get some serious questions asked at the interview, so be prepared.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

How are you certain she cancelled everything since you guys were on administrative processing? Did you receive notification that your visa application was no longer pending? Verify that she took the complete steps to "cancel" the process before you guys start all the way back over. Not exactly sure but maybe your case can be re-evaluated since you were under further processing (administrative processing)anyway. How long ago was this? Has the 6 week timeframe already passed?

ok..i did not know it..im new at it..so i was unaware...anyway thanks for ur reply....im ready to be asked all questions but i just need to know the whole process for re - applying, since old was cancelled due to some reason

Hi, u know she cancelled it...she's my wife. she told me..but u know i asked the US embassy in my country (Abu Dhabi, United Arab Emirates) and they informed me that the petition has been withdrawn...it was withdrawn just after 1 week of interview..they did not inform me the date of cancellation or the process of withdrawing the case....
