One other option you have is depending on which student visa you have, you may be able file for AOS here.

If your visa is a J type visa you may have to first meet a 2 year residency requirement in your home country before you can apply for a K-3 or CR-1 visa.

Is there a reason you didn't have this all figured out BEFORE you got married???????/

8-30-05 Met David at a restaurant in Germany

3-28-06 David 'officially' proposed

4-26-06 I-129F mailed

9-25-06 Interview: APPROVED!

10-16-06 Flt to US, POE Detroit

11-5-06 Married

7-2-07 Green card received

9-12-08 Filed for divorce

12-5-08 Court hearing - divorce final

A great marriage is not when the "perfect couple" comes together.

It is when an imperfect couple learns to enjoy their differences.

Marta,

Please search for keyword "adjustment of status," forms I-130 and I-485. Please check if you are on a J1 visa with a 2-year home residency requirement. If you are, then you would have to go home for 2 years after your education program before you can be allowed back into the US, or you have to apply for a waiver. If you are not, chances are you may apply for adjustment of status in the US without going home.

K1 (fiance visa) is out of question for you, since you're married and not engaged.

K3 visa applies if you live overseas. That is, if you are to go home now, you will have to apply for K3 visa to come back (assume your F1 expires).

You can maintain your F1 status if you want to and if it is still valid, and do AOS later. Or you may adjust your status now and abandon your F1 status. In either case, I think you'll be able to continue with your studies. Talk to your school's international office.

Do some research into this, and what I say here will make sense to you. Then you can decide what's best.

Regards.

K3, or maybe CR-1/IR-1. A K1 is for fiancé(e)s only.

Second that. If you are married already then it's no brain.

You need to file K3/4(if file with kids.) and followed with CR1/2

Marta,

I concur with those saying to research all the relevant information and the chance to remain in the US by adjusting status.

You can read more about foreign residency requirement, eligibilites and applying for a waiver when you are on a J-1 exchange visa HERE, if it applies to you.

If the two year home residency requirement does not apply to you then you can adjust status through marriage to a USC. Read HERE
