Hello! My name is Artur. I've been looking for an answer of my situation and i hope i will find it here with your help.

I will describe my case first:

I am 23 years old. My mother lives in Florida, we are from Russia. She is a green card holder (married on the American citizen, he was born in Russia too). She gets her Citizenship in 2 years, which would be 2014.

Not sure if it is relevant, but i will add some personal information:

I am getting my Masters degree in engineering and my girlfriend just got her math teacher's masters degree.

I lived In US for four years and have been married on american citizen, but marriage didn't worked out.

We are looking for a family reunification case. because it fits the best.

As i can see there is a two ways for us to do that right:

1) unmarried sun adult

2) Married sun with spouse

The thing is that I have a girlfriend here and, of course, we are planning on getting married, but im putting it on hold because i am not sure what is the best way for us to do that (in russia or somehow in America - I am afraid in the last case it could take a lot more time for me to bring her over in US)

My question is:

1) should we get married in russia but wait a little more time to go in US, But wait for it together here?

2) Or may be it is will be faster for me to get my family reunion first, get my green card and then bring her over as a spouse?

3) What is the time frames for both cases? Could you please describe it in details?

One question how old were you when your mom married ? I will assume over 18

You mom as an LPR can only petition an unmarried adult child

If she becomes a USC she can petition both married and unmarried , so you can't get married for about 3 years ( 2 years to file plus allow a year for processign/oath )

F2b unmarried son LRP = Jun 2004

F2 unmarried adult son of USC Mar 2010

F3 married child of USC May 2002

LPR applying for spouse Mar 2010

So your mother can start and application now and you are looking at 8 years, but if she gets her USC you will bump up and be almost immediately current. ( if you are single ) if you then marry with GC in hand you wait about 2.5 years for your wife to get hers.

If you marry now , your mom can't apply until she is a USC and then you wait about 10 years after that

This will not be over quickly. You will not enjoy this.

Did you live legally in the US? No overstays?

The previous poster suggested the best ways that are family based.

You could also try to get a company to sponsor you for a work visa once you complete your degree.

08.06.2010 - Sent off I-485
08.25.2010 - NOA hard copies received (x4), case status available online: 765, 131, 130.
10.15.2010 - RFE received: need 2 additional photos for AP.
10.18.2010 - RFE response sent certified mail
10.21.2010 - Service request placed for biometrics
10.25.2010 - RFE received per USCIS
10.26.2010 - Text/email received - AP approved!
10.28.2010 - Biometrics appointment received, dated 10/22 - set for 11/19 @ 3:00 PM
11.01.2010 - Successful biometrics walk-in @ 9:45 AM; EAD card sent for production text/email @ 2:47 PM! I-485 case status now available online.
11.04.2010 - Text/Email (2nd) - EAD card sent for production
11.08.2010 - Text/Email (3rd) - EAD approved
11.10.2010 - EAD received
12.11.2010 - Interview letter received - 01.13.11
01.13.2011 - Interview - no decision on the spot
01.24.2011 - Approved! Card production ordered!

REMOVAL OF CONDITIONS

11.02.2012 - Mailed I-751 packet to VSC
11.08.2012 - Checks cashed
11.10.2012 - NOA1 received, dated 11.06.2012
11.17.2012 - Biometrics letter received for 12.05.2012
11.23.2012 - Successful early biometrics walk-in

05.03.2013 - Approved! Card production ordered!

CITIZENSHIP

Filing in November 2013
