Now I've filed, am I able to fly within the US?

Hi guys,

So everything has been filed, I went to my biometrics yesterday and now it's the waiting game. I do have a question though. As I was in overstay whilst we gathered the file together, I didnt use any planes as I didn't want to risk anything. Now I'm in the middle of adjusting, am I able to fly within the states without any problem? I didn't file for travel authorisation with our paperwork, as I had no need to return back home. I do now however need to go to New York next month, and I really don't fancy driving there from LA.

Obviously if it's not possible, driving it is, but thought I would ask :)

Yes, you can fly within the US. It is a good idea to keep the NOA or a copy of it with you as proof of pending AOS, but most likely you won't need it.

To fly domestically the requirement is to have a government issued ID in which the name on the ID matches the ticket. So you use your passport. The TSA agent looks at the boarding pass and the passport and if the names match they stamp your boarding pass and on you go. My MIL traveled from Denver to NYC using her passport. They never looked within the passport for her visa only the bio page. TSA's job is to "protect" the flying public, not enforce immigration laws and on domestic flights you have no dealings with CBP. We flew to California while the wife's AOS was pending and she used her passport with no problems.

Have a good trip,

Dave

Filed: AOS (apr) Country: Scotland
Timeline

I travelled in the US while my AOS from a K1 was being processed, my 90 days were up at that point and I was worried too. I took my NOA1 with me, noone looked at it or even looked anything in my passport beyond the picture page. You should be fine but if it were me, I'd take all the AOS stuff you have to show that you are in the system.

Have fun.

This is all fantastic news!

Thanks for your help guys! I really didn't fancy driving all that way, so this is definitely great news!

I'll be sure to take the AOS documents, my NOAs with me, just as a back up just in case.
