Question: What is the easiest way for a us citizen to bring his wife and 2 years old daughter to the country. Less money and less waiting time.

File I-130 for wife. File separate I-130s for each child. Takes 1 year.

You must make 125% of the poverty line for a family of 4. See Form I-864p.

4? It's just him, the wife and 2 y/o daughter = 3.

Your are a citizen so once u make the poverty line, u should not have problems bringing ur wife and kid. An IR1 for wife and IR2 for the kid seems appropriate. Except there is something you are not telling. It should literally be a walk in the park.

there is nothing hidden. i just wanted to know that I 130 for daughter is easy or k4. that was the only question. thanks

I talked to USCIS over the phone and she was saying file i 130 for wife and then file k3 and k4 for child i dont know what is going on. thanks so much for help friends.

The USCIS customer service reps are contract employees. They're not immigration officers. Most of the time they have no idea what they're talking about.

The K3 is effectively obsolete. It was introduced at a time when spousals visas took years, while fiancee visas took months. It was a way to speed things up for spouses by allowing them to come to the US with a non-immigrant visa, the same way a fiancee comes to the US, and apply for a green card after they arrive. Spousal visas aren't taking years anymore.

Filing for a K3 requires you to first file an I-130. When that's accepted then you file an I-129F. Both of those petitions are now processed at the same time, and both will arrive at the national visa center together. The current Department of State policy is if they receive an approved I-130 and I-129F together then they'll administratively close the I-129F, and send only the I-130 to the US consulate. In other words, you will have wasted your time and money on the I-129F since you'll end up getting a spousal visa anyway.

The only advantage a K3 has over an IR1 or CR1 is that it allows derivatives, which means your daughter would be eligible to apply for a visa based only on the petition for your wife. However, you'd end up needing to pay for adjustment of status for both of them. Since the I-129F will end up being administratively closed anyway, there would only be an I-130 petition for your wife at the consulate. This means your daughter would NOT be able to apply for a visa. Don't let this happen. File an I-130 for each of them, and don't file an I-129F.

You have talked to an untrained, unwashed human.

But let's say, for the moment, that you'd like the take the advice from a SERCO employee that answers the telephone on the USCIS hotline.

Please call back 10 times over 2 weeks, twice a day, once in the morning, once in the afternoon, and ask the same question.

Record the answer each time, pencil to paper.

Then, after that, let us know what the top percentile answer was...

you can have it good, fast or cheap.

Pick 2.

K-4 is no longer available. You can try, but it's a waste of time (6 extra weeks at USCIS if you are fast) and then the I-129F is closed at NVC (which isn't USCIS) .

two humans? File two I-130's, keep them in the same shipping envelope.
