Hi everyone,

My Floridian husband and I got married in November 2010 and filed for Canadian Permanent Residence status immediately after and now have been approved and he has been here in Toronto since Oct 2011. He's not liking it here so we need to start the whole paperwork process all over again to file for me to live in the US. I was looking at the I-130 guide and it mentioned that got couple who have been married less than 2 years need to also file the I-751 form. Does anyone know if I need to do that even though I will be filing via DCF?

You can wait 4 more months and file for IR-1

If you've been married less than 2 years you get a 2-year green card and then need to submit I-751 after two years. If you've been married more than 2 years you get a ten year green card. You should be able to submit your I-130 now, then by the time of the visa interview you will have been married over two years.
