K-3 question

I am very confused about the k-3, I filed both the I-130 petition, and the I-129f for the purpose of a k-3 visa, but then after joining here I read many places that the k-3 is no longer used. So Im wondering what the USCIS will do about this? will they automatically turn it into a CR-1 or IR-1? if they do change it into one of those, how will I know which one?

USCIS will absolutly approve the I129F (after of course they pull your I130 out of line to marry it up to the I129F and put it in the back of the line) on the same day as your I130.

it is NVC that will close the I129F, they will notify you.

Plan on the Cr-1 route, read and research so you can prepare yourself

Good luck

Okay I’m still confused. If they will approve the I-129F and marry it to the I-130 and then the NVC will close it…does that mean that I will have to file all over again, and start the process over? And if they will move it to the back of the line then I will also lose my filing spot/month?

Read my post again, they will close the I129f, the I130 will travel through - putting you on the Cr-1 path

You lose your I130 spot. So your I129F NOA date is about 6 weeks after your I130 NOA date.

Good luck

  • 4 weeks later...

I was worried about the samething. I just got notice from the California Service Center stating that our I-129F Petition was Approved by USCIS and I will get instruction in the mail soon. It only took 4 months to be approved.

The notification did not say K-3 which is what I petitioned for my wife. I am sure they will let us know. I hope
