Hi Everyone,

My husband had his POE yesterday in Chicago and we are a bit confused. He received no documentation from the Customs officer apart from the temporary I-551 in his passport. The stamp reads 'Alien has been notified of the provisions of Section 216 and of the procedures for having the conditional basis of his/her status removed.' We are confused because he was not advised of anything relating to Section 216. We don't understand what 'Conditional Basis' is and what we need to do next. Will he be able to apply for a SS card? Will he be able to work? Will he receive his permanent Green Card in the mail? We have been married for two years so I don't understand why his residency would be conditional. If anyone can help we would really appreciate it!

It's conditional because you POE before your 2nd wedding anniversary so 90 days before your POE which will be 5/26/2014 you file your ROC (Removal of conditions). You can go read the guides. But in about 2 weeks he should receive SSN if not just go down to the SS office and get it. No worries.

Thank you so much for responding so quickly!

The POE was a couple of days after our second wedding anniversary so perhaps there has been a mistake? The IV issue date printed in his passport by the Embassy in London was for three days before our anniversary so perhaps that is the reason the conditional status? Any more advice is greatly appreciated...

The conditional status is really because be received his entry visa before you were married for 2 years. It is not the POE that matters so there is no mistake.

Petitioner LPR upgraded to USC June 22, 2012
August 22, 2012: case complete
October 18, 2012: Interview (APPROVED)
October 26, 2012: Picked up visa from DHL (delay caused by Sandy)
December 15, 2012: POE Atlanta....................became USC July 2016!!!!

Mothers' Journey (My sister is the petitioner)

September 10, 2013: Sent I-130 (UPS next day service)

September 12, 2013: Received text to confirm delivery

September 16, 2013: Received NOA 1

March 22, 2014: Received NOA 2
