Timeline

we are presently waiting for the approval of our F4 visa. our priority date is 1992 and at present immigration is already processing the year 1989. My concern is, I want to bring my 3 year old grandson with us. He is under our custody since he was born. We are planning to file a petition for custody in court to legalize us as his legal guardians. Can we bring him with us in case the petition for custody be approved in court? thank you and good day (This is a question from my officemate using my account)

No you can't bring your grandson under present circumstances. If you adopt him legally (not just guardianship), you MAY be able to, as you have physical custody of him for more than the last 2 years.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
