Annulment and condition removal

I need your help my visa journey family. I have a male friend who was married to an American who later filed for him and was granted the two year green card. Things were going well untill she started spending money like crazy and he was not making much in terms of salary which eventually led to the American wife leaving him before the interview date. She said she would file for divorce and collected money but never filed for divorce so he did. She contested the divorce and asked for annulment on the ground that he induced her into marriage for the purpose of immigration benefit, and was granted the anulment on this basis. I would like to know what options are availble to him to remove the condition on his green card which has already expired.

None, the annulment means the marriage basically never existed. Especially if the papers cite marriage for immigration purpose as the grounds for annulment. He also let the green card laspe. So he no longer has a valid green card to remove conditions from.

This will not be over quickly. You will not enjoy this.

Never , an annulment undoes the marriage. A divorce ends a marraige and gives the immigrant something to base their removal of conditions on. An annulment legally undoes that marriage, effectively leaving the immigrant with no basis for ROC. It is made worse by the "marriage for immigrant purposes" reason to earn the annulment and the fact the immigrant let the green card expire , which will be seen as an aknowledgment of their awareness that they have no basis for ROC. The difference between divorce and annulment is huge.

This will not be over quickly. You will not enjoy this.

Annulment does not preclude a person from applying to remove conditions. (See page 1 of the I-751 instructions) The judgement citing immigration as the reason for the annulment could be the sticking point along with having a lapsed green card.

Your friend needs to consult an immigration attorney to discuss all the details of their circumstances.

Thank you all for your responses. He has already consulted a very good immigration attorney and is not as bad as Nigerorbust indicated. It looks dire and believe me there is a way out because there is ample evidence to show that she lied about the marriage being for immigration only.I will keep you all posted of the outcome.
