Hello all,

Ok so it's going to reach the 2 year mark period already and it's time to deal with paperwork headache again.

I have a question for those of you who have been through it already.

My wife had past due to the IRS dating back from before we got married. We live in California which is a community property state. After consulting with an accountant we opted to file separately since otherwise the IRS would deduct my wife's debt from my tax return.

The bad side of it is that now we do not have joint tax return documents to provide. We have otherwise a joint account, a lease in both our names, bills, car insurance policy in both names, and several official document showing same address.

Do you think these evidences will make up for the lack of tax return papers???

You have plenty of other paper work showing you both have integrated your lives. Just be prepared to explain the tax situation.

I second Kennard on this one. There is no presumption that a married couple should file taxes together, and you do have the option to choose status as 'married filing separately'. Considering everything else provides evidence that you are in fact a legit couple you should be OK. Again, just be prepared to speak about the reasons behind this decision openly and truthfully. Hello:

In my last two tax return I filled myself and my wife as single, I made a mistake and paid more taxes for that, I already corrected that, but the fact is that at the time of the I751 I had not tax proof, so I got an appointment with and inmigrant officer to explain my situation and see if there would be any problem if I didnt submit the tax information, she literally told me that if we were really married and submit other information there would be no proble... I did that and received my green card extension with no RFC, of course I send a lot of other data, but as far as my experienice concerns, the tax return is optional as long as you have enough other proof.
