Hello all,

My wife is currently a PR, but I'm sure in a year or two will become a citizen. We've talked about the possibility of bringing over her mother and sister, but upon review of the requirements, I'm not sure if this is possible.

It seems a citizen can directly petition for a parent with no extra waiting time. It also looks like a citizen can not do this for a sibling. If both were petitioned for, would her mother immediately get a visa (after processing), while her sister would go onto the State dept. waiting list?

It seems the only possible way would leave her 16 yr. old sister behind for a period of 7-12 years! Is it possible to apply for her sister along with her mother at the same time, since mother would need to bring sister?

Convoluted, I know.

She can apply for both at the same time, but if she wants both to come together, apply firstly for Sister and then about a year before her Sister's number is current apply for her Mother.

Mother cannot bring child with her under any petition filed by your USC wife. It's just not possible.

The quickest way to bring them over is to first petion for mother. LPR mother petitions for unmarried child under 21.

Assume your wife becomes a US citizen in 2 years. It takes one year to petion mom. LPR mom petitions for Her unmarried child who is age 19.

It takes 3 years to petion for an LPR to petition for an unmarried child under 21 (f2a category). If child turns 21 while waiting, child will age out into the f2b category (LPR petitions for unmarried child over 21) which has a 7 years wait.

If you can get everything done as quick as possible, you'll have a better chance o getting sister over here when she is still college age rather than wait til her mid-20s.

If the filing fee isn't a huge things many sibling file anyway, that way there is an insurance if something happens to the parent(s). So if in two years your wife becomes a USC. ( sister will be about 18 ? )

Files 2 I 130 one for sister, 10 year wait, marital status doesn't make a difference

one for mother about 16 month wait for mom to arrive.

Mom arrives and files I130 for daughter Wait as an LPR for under 21 daughter is about 2 years. ( Sister will be over 20 ? ) if she turns 21 ( accounting for CPSA ) the wait jumps to 8 years , which will put her in line with the I130 your wife may have filed. In this class she must remain single until your mom gets her USC (IF she does)

This will not be over quickly. You will not enjoy this.
