Question for those who have been denied and sent an NOIR...

The documents, photos, receipts ect.. that you send to USCIS as evidence of a bonifade marriage...Do they keep these or do they send them back to you? and if they do....how long does it take for you to get your stuff back? :huh: :huh:

Anything that you've submitted is kept as a part of your USCIS file.

It's true you will not get back any proofs that you submit. I was sent a NOIR and I sent in 3 years worth of relationship proof including pictures. It took about 2 weeks for them to reaffirm our case and I didn't get anything back.

Wow......Im in the same situation as you were. I have 2 years worth of relationship proof. I do have alot of pictures so to make it easier for the CO who will be looking at everything I thought of doing a nice photo book. But since it wont be returned i guess I will just have to submit the prints I have (which is about 480 pictures).

480 pictures is too many to send with your NOIR response. I only sent about 12 pictures. They were pictures we took on my last trip there. I sent proof of the visit and pictures of him and I alone and pictures I took with his family. What's more important than pictures is joint income tax returns, emails, phone bills, chat logs, proof he is on your life insurance and Western Union receipts, things like that.

PeterJon.....I have actual printed pictures. I wish I would have known before spending so much money on these pictures. But thanks for the heads-up anyways.

carolynhotstuff......after the things the CO told me at our interview and the way he treated me and my husband..I want to make sure that they are completely convinced that my marriage is as true as a live person that is breathing. I am going to send every bit of what ever I have to so that my case can be reafirmed without any single doubt. I had taken a lot of pictures and proof at my interview but this guy refused to look at them...instead he laughed and mocked me for being organized and laughed at my proofs but did not look at anything. So I am sending all that this guy refused to look at plus the ones I have up to date. I have to fight with all I have to make this person swallow every nonsence and every inappropriate word he said to me.

I know...but USCIS is going to reveiew what the CO said and if it is anything like he treated us then I must be well prepared to prove wrong what he says. Once my case is reaffirmed I will update everyone. I just wish this process wasnt so long...I cant beleive its almost a year since my interview at the embassy and nothing has been resolved :( :( :( but anyways, Thanks for your help :star: :star: :star:

My husband just had his interview after we were reaffirmed. It was July 30th 2012. All the pictures that I sent in to prove a bonafide marriage was given back to him at the interview and so was all the phone cards we had saved up, but they kept everything else. Read my profile as well as my review. And we did not even need another affidavit of support like a lot of people were saying. You may be down but its not over and its well worth the wait. It had been 2 years since me and my husband saw each other and I made sure I was there for the interview. They cant send the petition back again unless they find something new, that they did not know before so you will be approved. NO WORRIES!

i was told by an immigration lawyer not to send any receipts from western union because it will look like you are trying to buy them.

also without a social security number, how do you get your husbands name on tax returns to make it joint returns?

also in the beginning before they, USCIS, approved oour petition i sent in all the extra info about 500 pages of everything they asked for on the RFE they sent me back in may 2011. when my husband went to the interview jan 2 2012 the lady in the embassy gave him back all that extra info,they said too much in his file, so the CO never saw it and when they sent our stuff back to USCIS, those papers were not in there.

You can call the IRS and they will tell you what to do to get him on your tax returns but that takes time and you only have 30 days to answer the NOIR.

My immigration lawyer told me to send the Western Union receipts and that's what I did. I guess each lawyer will give different advice.
