When to expect NOA2

Hi all,

I am on 191th day, 18th Jan is NOA1 date. I wanted to know when can I expect the NOA2? According to VJ timelines, VSC is not even approving petitions (for my category visa) daily. It has a gap of few days and the approved ones are of Feb or March, when will they look at the ones that are left from Jan.

I think you should call and see what's going on. It's over 5 months...

Absolutely call, and keep calling. Get a service request in place. You have waited longer than what anyone would consider is a reasonable amount of time. I have not heard of any March filers getting approval from VSC. CSC is really zooming along and is into April.

yeah i agree..just call USCIS and ask about your case..it's over 6 months, or maybe you will get NOA2 soon..

My husvband called to put a service request on 2nd july and recieved a reply on 5th july that they are still reviewing my file and i will recieve a decision or notice of other action within 60 days. My husband also contact congressman on 20th july; however, we do not have any further updates. Now what should i do, shall i still keep on calling them, would that not affect my file/approval?

In regards to possible RFE, does Petitioner or beneficiary have a common name which may relate to any person with the same name in their criminal records? Were there any previous marriage? Does petitioner have any criminal records?

These type of questions may possibly lead to RFE. If none applies, then chances are less for RFE unless there is a missing document in your I-130.

When a service request was submitted for my petition, we didn't receive a RFE either & 2 weeks after the request we got the approval! So chances are (& I hope) you don't get a RFE & your NOA 2 will be soon

There is a previous marraige of my husband and he has sent the divorce certificate with the I-130 form, he had filed petition for previous wife but due to divorce the file was withdrawn.. But incase of an RFE i should have received it by now (191th day).

Sorry to say but I see this as a possible "red flag" here. USCIS may also do a detailed check on your husband's ex-wife immigration status and whereabout. They may also check things like How long his last marriage stayed active and how many years ago? At which point in I-130 process file was withdrawn?

I have seen someone who filed in 1st week of December, 2011 at CSC got an RFE (had a previous marriage as well) just couple of weeks ago. So you cannnot really predict what USCIS is going to issue NOA2 or RFE at this point. Hope it's NOA2 only

FYI, I am assuming your husband's last name is "Patel". If that's true, then USCIS also knows that lot of Indian immigrants with this same last name do fraud marriages for a green card. I know it sucks if your relationship is genuine, but that's the way they see it.

Even if they want to do extra background check about the previous marraige, immigration status of the ex wife, how much more time they will take after 5 months timeline. its more than 6 months and 11th day

Unfortunately, I don't think *anyone* could give you an exact time. I know this wait time sucks. As per USCIS, 5 months is their goal to review your file and issue NOA2 and they consider out of normal processing time frame once it's more than 6 months.
