Hello all!

I'm a USC petitioning my French spouse. We both live in France and I will be returning to work in the US next month. Since I will be training for work for a period of 2 1/2 months, my wife wanted to come with me for a week or two then come back home to France.

What are the odds of being refused entry for a coupe weeks stay while her green card is being processed (we've sent the I-864 paperwork and are awaiting results, the I-130 is approved)?

I know the paperwork gives her no right to stay legally, but I've been told the chances of her being refused entry are high. Even for a few a week or two? Note that we haven't travelled to the US in about 2 years.

Your feedback and advice is greatly appreciated!

With a return ticket her chances of being allowed in on the visa waiver are very good, but nothing is certain.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

I agree with Penguin_ie. Nothing ventured, nothing gained.

There is never 100% certainty in the outcome with USCIS but you should at least attempt it.

A denial might mean she may not use the visa waiver in the future (look into that possibility).
