Hello Everyone

me and my fiance wants to get married in the US but we dont want to live there anytime soon (since he works abroad) , can we apply for a k-1 visa and get married in America and leave the country? or we have to stay there for a certain amount of time ?

any openion or advice will be highly appreciated

You sound like you are just interested in a destination wedding, there is no need for a K-1 unless you plan to live in the US after your wedding. You will only need a tourist visa or vwp if you are applicable.

we just want to get married in the states because its too complicated to get married in my own country and all our tries to get married there has failed , we been with each other since 2009 :(

we dont know what to do or where to begin :crying:

if you have a tourist visa just go to the USA and get married, then come back home... If you don't, apply for one. It will be much quicker (not sure if easier) but you can try ;)

Please bare in mind that they might be difficult at the POE if they find out you are going to the US with the intention of getting married. They might assume you are going there to get marry and stay so you would have to show some proof of ties to your country :)

Yes, you can leave the USA after marriage... but you would not be able to re-enter USA or adjust your status to resident. Once you live together in another country as husband / wife for 6 months or longer, you can then file spouse visa directly through the consulate, which is a fairly quick process.

As I said you only need a tourist visa. Visit the US. Marry. Leave.

Guess no one looked at the country the prospective spouse is from. Certainly apply for a tourist visa but seriously doubt it will be approved. The good news is a legal marriage in any country is valid in the US. When both of you are ready to live in the US you would file for a CR-1 visa for the non-USC.

Best wishes on your marriage and if you can't get the tourist visa try for a marriage somewhere exotic, Thailand maybe, it will be something to talk about for years.

I agree with Xanax. No need for a K-1 visa if your intention is not to immigrate to the US. Come visit, get married and come back to your country (don't overstay)!
