According to a transcript of an interview that will air Wednesday night on NBC Nightly News, the presidential candidate said “it was illegal for him to have many of those [weapons] already,” and suggested that stronger gun laws would not have prevented the tragedy. Instead, Romney claimed that the way to deal with such senseless violence is by “changing the heart of the American people”:

ROMNEY: Well this person shouldn’t have had any kind of weapons and bombs and other devices and it was illegal for him to have many of those things already. But he had them. And so we can sometimes hope that just changing the law will make all bad things go away. It won’t. Changing the heart of the American people may well be what’s essential, to improve the lots of the American people.

In fact, 24-year-old Holmes legally purchased every firearm, bullet, and piece of tactical gear that he used for the attack, according to local law enforcement. He bought most of it over the Internet. Mentally ill people are barred from purchasing firearms, but Holmes had no previous record of illness, and would not have been flagged in a background check.

I'm no fan of Romney but my guess is he may have been referring to the bombs not the guns and simply worded his thought poorly.

this statement is entirely accurate.

possession or manufacture of anti-personnel explosive devices without ATF permit or tax stamp is a federal felony in most cases. according to reports there were more than 30 explosive devices involved. in addition, possession of body armour while in the commission of a felony act of aggression is also a crime in most states. there is no indication that the aggressor had a concealed carry permit, so possession of the handguns and transportation of long guns to a destination other than legitimate purpose destinations outside of his home is a misdemeanor 3 or felony in most states. entering a theatre that is posted in accordance with state statute as "no guns allowed" is a criminal offense of defiant trespass, at minimum. buying a gun with the intent to use it in criminal activity is conspiracy to commit. bringing a gun to a location to use it in a crime is also generally a prohibited offensive weapons violation. i could go on...

Shouldn't have had any kind of weapons? That statement is demonstrably false - the very weapons with which he killed and injured dozens of people, he actually acquired legally.

Mitt has a troubled relationship with the truth. What a guy!

you missed one (actually several offenses wrapped up in one), it's called "fugitive from justice". being in possession of unlawful explosive anti-personnel devices the shooter was a fugitive from justice (even from the moment of first intent to make them). by signing the ATF 4773 transfer form with an affirmation that he was not a fugitive from justice the shooter committed a felony perjury. taking and remaining in possession of firearms while in possession of such unlawful explosives is a criminal offense under "prohibited persons" in USC title 18 Sec 927.

"An individual who, after having committed a criminal offense, leaves the jurisdiction of the court where such crime has taken place or hides within such jurisdiction to escape prosecution." (definition of fugitive from justice)

(2) regulations providing for the issuance, at a reasonable cost, to a person licensed under this chapter, of certified copies of his license for use as provided under regulations issued under paragraph (1) of this subsection; and

No such rule or regulation prescribed after the date of the enactment of the Firearms Owners’ Protection Act may require that records required to be maintained under this chapter or any portion of the contents of such records, be recorded at or transferred to a facility owned, managed, or controlled by the United States or any State or any political subdivision thereof, nor that any system of registration of firearms, firearms owners, or firearms transactions or dispositions be established. Nothing in this section expands or restricts the Secretary's 1 authority to inquire into the disposition of any firearm in the course of a criminal investigation.

(b) The Attorney General shall give not less than ninety days public notice, and shall afford interested parties opportunity for hearing, before prescribing such rules and regulations.

© The Attorney General shall not prescribe rules or regulations that require purchasers of black powder under the exemption provided in section 845(a)(5) of this title to complete affidavits or forms attesting to that exemption.
