I-94 Arrival/Departure Form

Timeline

AT POE, K-1 Fiancee will fill out the I-94 "White Form" - Arrival/Departure Record, which they will need later for other things like SSN and AOS. Have you noticed, it has a question 4. Country of Citizenship, which of course, their home county would still be the answer, but the usual confusing and ambiguous US form question, is question 8. "Country where you live" - would they now put "US" there, even though they haven't actually started living here yet. They will no longer be living in the country they are entering from......Thanks

Third visit April 2012 for two weeks (met all her family! Lots of "Ganbei!!!" (cheers) with her brothers with 100 proof - whew!))
05-09-2012 - NOA2 Received
05-09-2012 - ???? - CSC accidentally sends approved NOA2 to a storage facility, then has to retrieve it - Auuggghh!!
07-02-2012 - NVC Received
07-26-2012 - Packet 3 returned
07-27-2012 - Packet 3 received (yes- one day after she already sent it in- mini short-cut)
08-09-2012 - Packet 4 e-mail received
09-04-2012 - Interview
09-19-2012 - Received Visa
09-28-2012 - Ying's POE date (Chicago O'Hare)
10-27-2012 - Married!!!
11-20-2012 - AOS forms sent to USCIS

12-26-2012 - Biometrics Appointment

02-10-2013 - Ying gets I-512 Combo work authorization and travel authorization advanced parole card

06-23-2013 - Ying returns to China to assist with completing son's K2 Visa

07-10-2013 - Ying's son, Zongyang, passes K2 Visa interview in Guangzhou

07-29-2013 - Ying's I-485 AOS is approved

08-03-2013 - Ying's 2 year green card arrives in mail (she's still in China with son)

08-08-2013 - Ying and Zongyang enter US, HK to Toronto to O'Hare

Q4 - Country of nationality - normally the same country that issued the passport with which the beneficiary is travelling.

Q8 - USA.

Since the K-1 visa is kind of a halfway house in terms of status, the presumption is that you will be entering the US to take up residence.

Hey stevo222,

Thanks for the good words. Did you by chance see my reply? The key to question 8 is- What their current country of permanent legal residence? Reading your question, you answer your own question, see bolded portions. Don't think of the future, think of the present situation, when they arrive at the POE, they still haven't been admitted into the US, no AOS, no nothing.... The AOS process is a process that (hopefully) culminates with allowing an eligible applicant to become a lawful permanent resident of the US.

It is confusing, refer to I-194 instructions for details.

Am I reading two different opinions here? Gegel, you say USA, but A&B, it seems by saying "not living in the now, not the future", she would put China down.

A&B, BTW, waiting for interview date, but Ying did send in the P3 now, so should know very soon.

Yes you have two different opinions and both are correct, i.e. it doesn't matter what she answers in Q8, really. She will be allowed in and that is what counts.

We can make the case for either the US and China successfully, on this one.

Country where she resides would still be China for #8 since she has not even entered the US yet and is not a resident or living there.
