Change from I-129F to K3

Hello Everyone,

Petition I-129F was approved on 9-1-06 and was sent to Jordan Embassy, my fiancee appointment with the consulate is 6-17-07. That is way too far from now, we have been engaged since november 2005. If we decide to get married in Jordan, could we change our approved I-129F to a K3? Would I file for the K3 in Jordan or do I have to go back to the US to file the K3?

Now I know when you file for a K3, you must file the I-129F first. But I already did that. This is sooo confusing. Any advice will be greatly appreciated.

You have to start over again. There are different documentation requirements for the I129F for K1 and K3.

A K-3 visa petition is filed in the US. I do not know if DCF is available in your Embassy.

I saw the answer on the consulate website that my fiance and I will be using.

We decided to get married before my K-1 petition could be processed. What should I do?

If you get married, your K-1 petition will no longer be valid. Your spouse will need to file a different petition, Form I-130, with the CIS.

So you will just set your self back to square 1 and just prolong the wait time.

Why would you want to start all over again if your fiancee already has an interview date? Some people are still waiting just to get an interview. Do you know for sure that filing K3 can get you an interview sooner than 6-17-07? If it were me, I wouldn't risk it unless I was absolutely sure K3 would get me a quicker interview. And I really don't know if anyone here can guarantee you that. It's all a waiting game regardless of which path you choose. If you do start over and file for K3, you run the risk of making mistakes in your paperwork, getting a RFE, delays in processing at the service centers, delays at the embassy, etc, etc. So many factors can come into play. It's all a risk and you need to decide whether you want to take the risk or not.

considering it'll take time to get married, and more time to type up the forms, and mail them again. Then minimum 6 months these days for K3 approvals, and then another 6 months to schedule an interview...you'd set yourself back another year or more if you get married now.

Just sit tight and wait it out.
