C'est correct je vais tout traduire pour toi. SVP envoie moi un message si je repond pas.

As I said, "It's Ok, I will translate everything for you. Please send me a pm if I don't reply".

Her question is as follows:

------------

Hi everyone. I'm an Algerian woman that lives in Alger. My husband has been living in the USA for about 6 months now. He obtained the green card via lottery (in 2010).

He consulted a lawyer there who explained to him that the procedure to bring me there could take up to 2 years. This is rather long for me and I know I have to be patient but it's hard, especially since he hasn't yet filed for anything yet. I'd like to know if I could ask for a Tourist via or a Student visa while he's filing for me.

In other words, what is the fastest/best way for me to go to him? Thanks in advance

-------------

Sorry if my translation isn't perfect but I did it very quickly. ;)

**** Moving from K1 fiance visa to Bringing Family Members of Greencard Holders. Please, no more non-english in this thread. ***

You can try for a tourist visa (6 months visit at a time, cannot work) or a F1 student visa (must go to university full time- fees are expensive). When did you get married? If before he got his visa, why did you not go with him?

Rabi Ma3k.

Hi daroum! Welcome to MENA VJ.

I need to bone up on my french and arabic languages well enough to read and write fluently in them so I can be of some help here.

Yes you could try for a tourist visa or even a student visa and it's not very difficult but it will cost money and is not always guaranteed. Women being petitioned for don't have as difficult a time from the MENA region with their petitions. I suspect in your case since your husband came on a lottery visa and you're already married that it will be rather quick and easy for your case.

My question is what is holding up your husband from filing as soon as possible to bring you over here? Is it money? If it is money then I'd put it towards the family based visa of CR-1/IR-1 because the K3 no longer is an option. The processing times have increased on the CR-1/IR-1 with the average taking about 11 months from first filing the petition to receiving the visa to travel here. I'm not certain about Algeria though because sometimes the visa process can be case specific. Your husband should really file that petition quickly because there is no reason you should have to endure a long distances relationship. LDRs are really difficult especially when you're both already married. It was so stressful on me waiting all those years for my husband to come here and now I think if it was for my protection or the countries then the extreme caution and background casing was all for nothing really. He's fine and like a lamb really. We couldn't be happier now that we're counting the years together instead of day, weeks and months. Couples getting to be together is happiness and being apart is pure hellishness.

I hope you guys get to be together soon and that you keep us, in the MENA forum, updated on your case and what you decide to do.

I did a simple timeline search for the average processing time for CR-1/IR-1 coming out of Algeria.

Here take a look: My link

oops I see it just takes you to the search engine for it on this site. Well if you put in the details which you may have more of you'll be able to see it and read the recent data for yourself and look at individual timelines of other people going through the process for comparison.

It might be 11 months if the petitioner is a USC, but isn't it different if the petitioner is a permanent resident (as hers is)?

Sorry - brain hasn't woken up yet, and I'm really rusty on immigration things now....

I'm not really sure if it makes a difference if the petitioner is a USC or LPR. I have never read on here there being much of a problem with that before. I was looking at the recently updated immigration timelines for Algeria on the CR-1/IR-1 visa.

The average is about 6 months from filing to NOA 2. The USCIS processing center that takes the least amount of time is the Texas Servicing Center then the Vermont Servicing Center and last is the Califonia Servicing Center with an unusally long amount of time. Unfortunatly depending on which State he lives in will decide which processing center the petiton will be routed to with California being the most that petitions go through. There doesn't appear to be any stats for the Nebraska Servicing Center for Algeria petitions on here.

Without looking at individual cases and seeing who has the large wait that is skewing the numbers the average wait is 651 days or around 1 year and 9-10 months. So what they said to her about 2 years may be more accurate for Algeria. Gosh that is an awful darn long time to wait on a petition to be with your spouse. :( I've been there myself with that long of a wait.

He should really get on the ball and file the petition now for his wife. The sooner the better.
