Greetings to all Vj members, I am a permanent resident (10yr GC) but currently separated from my wife due to lots of serious problem from her and her family(Long story). We are looking to divorce but the North carolina law require a year of separation before the divorce can take place. I'm due to apply for citizenship by the end of this year. Is this still possible since we're separated and not divorce yet? Also how long can i wait before I can get married again?

Wow...I feel shocked. Apparently you have not had any committment toward you marriage for a long time if you are already asking about marrying again already. I guess if I was in your situation a new marriage would be the last thing on my mind....

In many US states, you can't get remarried until the year passes from the point that you go separated, sometimes 2 years, unless you use another method outside of voluntary separation.

For example, if you never consummated the marriage, maybe you could annul it. Or you could take a trip to your home country or the caribbean and get a divorce within hours of the court opening. You should talk to a lawyer. You should also talk to your wife about how to separate and move on with your lives. Or try to work things out...

Your application for naturalization at this point rides completely on your personal record, in terms of keeping your residence and paying your taxes. Your marital situation will not help nor hinder that process.

You can remarry once your divorce is final and filed, and not one day before, else you will be breaking the law.

Technically speaking you can get married immediately following when the Divorce is finalized. I also live in North Carolina and was separated for more than two years before my Divorce became final this month. I have just filed my I-129F and will marry my Fiance within 90 days of her arrival to the US.

The relationship has been rocky for the last 1 year. We had marriage counselling more than 3 times but still everything didnt work out. There is too much interference from her family and I did everything I could to make her understand it's our life not thiers, but unfortunaltely she didnt see it dat way. She got back to the father of her two kids , just 2 weeks after I moved out of the house (that means something has been going on between two of them before I moved out, which im not aware of). I need to move on with my life , I didnt enjoy my marriage for the last 1 year. There are more to all this than what I just said but I cant wash my dirty linen in public. I hope you understand before you crucify me!!!!
