I864- by wife and Her Dad

I got married on 07/06/2012 and now collecting all documents. I got I864 filled by my USC wife and her Dad as she does not have much income and I am working on OPT. I have some doubt,

1) Can I add my income(section 24 b) I864 filled by my wife? Would I get RFE for that as I am working on OPT(non continual source of Income).

2)My wife filled her tax return for 2011 and paid the amount to IRS she owed to IRS. But when we applied for Account transcript and Tax return transcript , we only got Account transcript showing that "Return Not present for this account" .So what should I send as proof for tax return? I got the cheque copy from online banking site and also the 1040 form. would that be enough?

3)her dad gave me his pay slip, bank statement and Tax return transcript for last 3 years and form I864 , would that be enough?

Don't worry, you'll get plenty of help soon. It slows down at night and will pick up a bit later in the day around here.

I'm no expert on the I-864, but my understanding is that you can't use your income if it's not going to continue after you get your greencard.

You can send a copy of your wife's 1040, send her w-2 too, and I believe recent paystubs. (That's what I sent and I haven't gotten an RFE so far -fingers crossed.)

Same things for her father.

When did she file her 2011 taxes? If she filed before April 15th, I would think the IRS would have them by now. I would probably call the IRS, just to ease my own mind, but sending a copy of the tax return should be enough for your I-864.

thanks for reply, I am working for the company as FTE and they also filled my H1B(decision pending), Her dad income would suffice all the requirement, I just wanted to add my Income just for showing purpose.

If you don't need it for income purposes, then I would just leave it off. Including it would probably increase your chances of an RFE (if there was something about it that USCIS didn't like.)
