Timeline

Dear VJ Members, I need someone to help me out regarding this. We are waiting for our NOA2 for the K1 Visa, but my Fiance (the petitioner) called me that she lost her job and she's thinking of applying for food stamps before she get another job. My question is, what's the implication of this on our K1 Application? Will this have any effect or cause a denial? Any information will be highly appreciated. Thanks!

24-04-2013................... NOA1 received by text and email.

29-04-2013................... NOA1 received by post for AOS and EAD

03-05-2013...................Received biometric appointment notice.

13-05-2013...................Received RFE for AOS by text

20-05-2013................... Biometric done

09-06-2013.................... Sent RFE response

12-06-2013..................... Case updated to Response review

06-07-2013..................... EAD Approved

13-07-2013...................... EAD received in Mail

USCIS Receipt of I-129F: January 24, 2012 | Petition Approval: June 15, 2012 (No RFEs)
Interview: October 24, 2012 - Review | Visa Delivered: October 31, 2012



Part Two: Entry and Adjusting Status:

POE: November 18, 2012 (at SFO) - Review
Wedding: December 1, 2012 | Social Security: New cards received on December 7, 2012.
AOS Package (I-485/I-765/I-131) NOA1: February 19, 2013 | Biometrics Appt.: March 18, 2013
AP/EAD Approved: April 29, 2013 | Card Received: May 6, 2013 | AOS Interview Appt.: May 16, 2013 - Approved Review Card Received: May 24, 2013

Part Three: Removal of Conditions:

Yes , her mum promised to serve as co-sponsor.

Yes , her mum promised to serve as co-sponsor.

As long as her mum is set as a co-sponsor -- and I'm assuming that would hold true for the adjustment of status where the I-864 actually legally binding -- then her situation shouldn't impact the interview. The key thing is that you won't become a public charge and that either the petitioner or co-sponsor will be on the line to repay anything. That said, since you're still waiting for the NOA2, it's possible that she'll find a new job by then as well. Good luck!
