My parents are U S Citizens and they petitioned for my siblings back home in Nigeria, the petition was filed 31st of May 2011, i would like to know when this petition would be approved it is over a year, may 31 2012 made it one year, now we have not received any approval letter yet, my siblings are over 21 yrs old and unmarried.

hi,

it can take years, depending on the service center. the wait until the priority date is available currently is around 7 years if they continue to be unmarried, if they marry, the wait is around 10 years.

Approval of the I-130 is only the first step. Your siblings must still wait for their priority date to be current. That will take seven years.

There is no rush to approve the I-130. It will take seven years for your siblings priority date to be current, so approval of the I-130 will have zero impact on the wait.

It doesn't matter much as you already have your priority date which is what will determine when they interview. If you wait 8 years for a visa there is no difference between the petition getting approved today or in 5 years. The approval date means nothing if all the children are over 21

This will not be over quickly. You will not enjoy this.

When the petition gets approved only matters if a person is under 21 when you file, because of age outs. Your siblings are over 21, so whether the petition gets approved this year (likely, but not certain) or not really doesn't matter. It does not mean the visa will be approved down the line either.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
