Hi from Markie and Mark here.

We're just starting off our K1 visa process, compiling our I-129F package and our only concern (so far) seems to be the I-134 form. I am 22 and a student just about to start the final year of my degree in the UK. Markie, 19 in September has graduated high school in May and is currently working this summer on minimum wage but intends to spend a significant part of this year with me in the UK while I complete my degree. So we will obviously need a co-sponsor.

Do we need to sort out the co-sponsor when filing for the K1 visa or when applying for the AOS after the marriage?

We are also unsure who to use as our co-sponsor as Markie's parents both have low income. We initially thought Markie's grandparents would be most suitable as they are very (and I mean very) well off. However, they retired last year and so have no source of active income. Does the co-sponsor need an active income to be suitable even if they are extremely well off? Also, how many co-sponsors can we use? I have seen things suggestive that it is just 1 and just 2 in others :s .

Any help is much appreciated (as is all the work that has gone into creating the wonderful information source that is this forum).

You do not need to add the I-134 page with the initial I-129F packet. You will need the I-134 for the interview stage and will need the co-sponsor to fill out a I-134 also. Unfortunately I cannot answer the other co-sponsor questions. But make sure to send out your I-129F application asap. Good luck.

You will need the I-134 at the interview for the visa. Then when you adjust status you will need the I-864 which is the legally binding one. Sounds like her grandparents should qualify. (Markie will also have to complete an I-134 and later an I-864.) Retirement income is fine. or assets. Just one co-sponsor so one grandparent will complete the forms and if necessary the other will include his/her money as a household member.

Markie's grandparents would be most suitable as they are very (and I mean very) well off. However, they retired last year and so have no source of active income. Does the co-sponsor need an active income to be suitable even if they are extremely well off?

If retired they may receive a pension or social security, which counts. They can also show assets--savings, investment accounts, cash in the bank and thus qualify. He should ask them first to see what they have to say. It's a big responsibility and they may not agree to it.

You may have one joint sponsor on the I-864 in addition to your husband being the primary sponsor.

For the I-134 in London, just a sponsor. If your fiance can't sponsor, then the grandfather can be the sole sponsor.

A co-sponsor can be any US citizen or legal permanent resident residing anywhere in the US. The I-134 is used at the K-1 interview, then later after you are married and filing for adjustment of status, you will need the I-864 affidavit of support.

You need just one of the grandparents to fill out an I-134. They can use retirement pay or assets at 5 times the income amount needed. For example, if they needed enough for a household of 3, themselves plus you, then they would need $23,862 in income, at least $119,310 in assets, or combo of income and assets. http://www.uscis.gov/files/form/i-864p.pdf
