hi everyone :

We just received a notice from USCIS, requesting additional information or evidence fo the case, My fiance came to visit me the 17th and went back home this morning, they send us an emailthe 19th, but we didn't check our emails of course bc we wanted to be together the whole time, now our case will be in suspense untill they receive the infotmation or additional evidence of the case, but the question here is : WHAT ADDITIONAL INFORMATION OR EVIDENCE IN THE CASE DO THEY NEED FROM US? I CALLED THE USCIS THSI MORNING AND THEY COULDN'T HELP ME!! AM VERY WORRIED .. THANKS A LOT!!

there nothing you could do right now is to wait for the rfe hard copy...they won't give you any info if u call uscis...like they always say "it's confidential"..just wait for your love letter from them it will be a blue paper. goodluck!!!!

The longer it takes to happen the more you'll appreciate it when it does!

There is nothing you can do until you get the hard copy in the Mail, it should be arriving anytime now. The letter will tell you exactly whats exactly they want. just follow the instructions in the letter and you should be ok. for the time being, dont stress it, just relax.....its a common thing for peeps to get request for evidence

Well, you could run over your petition and see if you might've missed or forgotten something. It's quite a few pages to run over so might as well wait until receiving the hardcopy so you'll know exactly what to submit.

USCIS can't help you because they don't hand out personal information through the phone. That, and then a tier 1 rep is pretty limited in which info they can provide.

K1 process, October 2010 > POE, July 2011

I-129F approved in 180 days from NOA1 date. (195 days from filing to NOA2 in hand)

Interview took 224 days from I-129F NOA1 date. (241 days from filing petition until visa in hand)

My boyfriend just got the RFE , they want proof of how we met in person, I MEAN, WE DON'T KNOW WHAT TO DO, WE SENT IN PICTURES OF US, BUT WE DON'T KNOW HOW TO PROVE THAT WE MET IN PERSON, THAT HAPPENED 3 YEARS AGO and there was a short period of time that we broke up, I was mad at him so I deleted everything such as pictures, emails, everything, bc I did not want to have anything that could remind me of him back then,1.5 months later we got back together, and never break up again, here we are now... trying to prove that we are together, in fact he just went back home yesterday in the monring... it's been 6 months since am back in my country and he came 2 times to visit me already, the first time he stayed with me for 3 weeks, and this last time for 1 week, what should we do now?? HOW TO PROVE THAT WE MET IN PERSON 3 YEARS AGO?I mean that's stupid, sorry, but it is, if we sent in pcitures of us, that means that we have met in person, am soo nervous and upset, and feel like I don't want to try anymore, am afraid that we wait for months or years and we don't get approved...... we love each other and we want to be together.. WE EVEN LIVED TOGETHER FOR 1.5 YEARS...:( thanks

OK. Relax. Deep breaths. Deep breaths.

It is my understanding that: You need to prove you met within the 2 years PRIOR TO the date that you sent in the petition. That means his visit to you in the past few months doesn't count. It has to have happened BEFORE the petition date, and not more than 2 years before it.

That's the first rule. Secondly, pictures are apparently not primary evidence...because if you think about it: How will the adjudicator know WHEN the picture was taken exactly? Since the timing is important (see above reason), then it's important that you prove that you 2 met within the acceptable period of time through hard facts. If you lived together in that time period, provide a copy of the lease with both your names on it maybe? Provide passport stamps that prove you 2 were in the same location at the same time? Anything "official" with a date on it that is a hard fact that you 2 must have both been there to make it happen will suffice. Pictures/emails/call records/etc will not do that.

Yeah I understand that, but I lived in chicago for almost 3 years, thats when we met, I lived with him for 1.5 years in the stats, We came to my country on vacations, then we went back to chicago and they didn't let me in, since they figured that I was living in the states on a tourist visa, so they sent me back home and took my visa away, I was living with him, so the USCIS must be aware of that also, so I don't understand anything...

OK, if you lived together for 1.5 years, can't you provide any proof of that (other than pictures)? That would show meeting within 2 years prior to submitting the petition as well as continued relationship.

Tell them circumstances of how you met 3 years ago, but that is not really what you need to prove. You need to prove you were together in person within the last 2 years prior to filing the I-129F. You never assume the USCIS should just 'know it'. You must prove it. Photos are not primary evidence of being together in person. You need to show rental agreement in both names(since you stated you lived together), passport stamps, boarding passes, train or bus tickets, and ATM, hotel and/or credit card receipts from the location where the 2 of you were together in person. Photos are secondary evidence that you provide to back up the primary evidence. Show photos of you together and with friends and family during the time you state you were together face-to-face. If you have any in front of well known landmarks, even better.

If you have no evidence that can convince the USCIS that you in fact were together in person within the last 2 years, then you may need to withdraw the petition, have another visit together, get and save primary evidence and photos of that visit together, then file again.

If you stated you met 3 years ago, that's why you got RFE'ed. USCIS is asking for proof that you met once or more in the past 2 years prior to filing the petition. Your secondary evidence(such as pictures or statements from family members) only supports your primary evidence. Without the initial evidence, then your secondary evidence isn't convincing USCIS.

Regarding primary(initial) evidence: When did you last see each other prior to filing the petition? Passport stamps are always neat since they're from a 3rd party agency that's less likely to be doubted. Lease agreement in both your names, credit card statements/transactions showing you being in the same area(I sent one with my full name and adress showing I had been in my husband's city and used the ATM machines). Just remember only to send copies of it - you keep all originals and bring it with you to the interview.

If you have seen/visited each other AFTER filing the petition, that evidence/meeting can't be used in your already submitted petition. It's good for taking with you to the K1 visa interview at the embassy to show ongoing relationship however.
