Hi,

I am nabeel living in Pakistan. I've been working as a freelance internet marketer for a company based in USA. They are interested in offering me an in house job but we both don't know the process how i can get there. I would appreciate if someone can tell me the process how my company can process my visa application or what steps they should take to get it done.

The US company has to sponsor your work visa (H1). Not sure what you mean when you say they do not know the process of getting you here. All prospective employers have to sponsor H1s for international employees that they wish to get into the US. Their lawyer must be able to advise them best on this.

Arrived on F1 visa on 25 Dec 2008. Graduated June 2011. Started OPT Sep 2011.

AOS applied March 21, 2012. GC approved June 11, 2012 & received June 18, 2012.

Exactly three months from start to finish,no RFEs.

AOS Timeline:

Day 01,March 21, 2012: Concurrent filing of I-130/AOS/EAD/AP to Chicago Lockbox

Day 02,March 22, 2012: Package delivered to Chicago Lockbox

Day 04,March 24, 2012: USCIS Acceptance Confirmation received through e-mail

Day 07,March 27, 2012: Checks cashed.

Day 13,April 02, 2012 : NOAs received for I-130,I-485,EAD/AP & Biometrics

Day 36,April 25, 2012 : Biometrics Completed at Elizabeth, NJ.

Day 45,May 04, 2012 : E-mail notification for interview received for June 11

Day 46,May 05, 2012 : Received hard copy of interview notice

Day 56,May 16, 2012 : EAD/AP Production e-mail

Day 64,May 24, 2012 : EAD/AP Card in hand

Day 83,June 11,2012 : Interview. Approved same day. Card production email.

Day 84,June 12,2012 : E-mail Notification registering PR status.

Day 87,June 15,2012 : USPS picks up GC from USCIS.

Day 88,June 16,2012 : Received two hard copy mails, approving I-130 & I-485

Day 90,June 18,2012 : 10-year GC in hand. End of GC journey, for now.

They need labor certification (essentially, proof no US citizen can do the job) and send it documents. Then you will have an interview at your local US embassy and have to prove you have the qualifications/ experience you claim.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Hey Queen,

That's something really helpful. Can you also please share some links in this regard. I need to document all those points in bullets so i would prefer to do more research on that. Share some authentic links that tell cost, labor certification etc etc..

You have already got some good answers here. This is something they will have to discuss with their lawyer and the lawyer is the one who can give you any good guidance on this. Do they have a lawyer? If so, you can rest easy.

They actually wanted me to submit a PPT presentation doc explaining each and everything about it. I did some research before asking you guys and found a lot of information that a normal human can't understand like the visa terms, unnecessary theory etc..

It seems your company has never done this before and they dont have an immigration lawyer nor an educated HR dept.

If they would had that they would not need you to do a presentation, this information is readily available to anyone and for any company who has done this before knows the details.

I agree with the others here, your company should know the ropes and must hire a lawyer.

Be warned that investing your future in a company that does not even know how to go about the immigration process is a calculated risk. Immigration is a labyrinth and you need to watch where you step, else you are toast. Also, if they have never done this before,I would suggest you look for another employer. All the best!

Bearing in mind you job it seems somewhat odd question to ask here.
