I am filling my ss-5 form, and I am not sure how to answer item #5. Am I a legal resident allowed to work or not allowed to work? I am on a K1 visa and I need SSn in order to get married. Thank you.

You can't work until you file for the EAD and your SSC will say not allowed to work without DHS authorization on it when you receive it.

Though you are not allowed to work, for SSA purposes you are a "legal alien allowed to work" or otherwise they don't have the means to assign you a number. You do not need the number to get married.

There was a federal law passed that if a person does not have a SSN, then they are not required to have one to get married. You are eligible for a SSN, so if you want to get it, go ahead, but I am sure if you read the actual MN law you will find you don't need a SSN if you do not have one. Training the clerks about this is another matter, perhaps.

You do not need a SSN if you don't have one. It is not mandatory.

(4) if either party has previously been married, the party's married name, and the date, place and court in which the marriage was dissolved or annulled or the date and place of death of the former spouse;

(5) if either party is a minor, the name and address of the minor's parents or guardian;

(7) address of the bride and groom after the marriage to which the local registrar shall send a certified copy of the marriage certificate;

Do not need SSN to get married in MN. Husband did not have one when we got married.

If you are changing your name you can save yourself a trip to the SSA office if you do it after you get married and get the card in your married name rather than doing it beforehand then going back to have it changed.
