Hi everyone. I submited my I-130 (NE Service Center) in late July and it was approved this week on October 16th. I don't know much about all of this, but from what I was told we were going to pursue the K3 Visa. Due to bad information I got from my immigration lawyer, I missed the first NOA because it was returned to USCIS undeliverable, hense I couldnt get the K3 paperwork in fast enough. The thing is, the I-130 was approved so fast, I was told we cant file for K3 now. Is that true? If so, what is next? My wife is in Cebu Philippines, I am excited the petition is approved, but will that set us back or get her home to the US quicker? THanks for any remarks :)

you will need to go with CR1 your wife will come here with a green card not with a visa so you will need to pay 70 $ for affidavit of support that they will send you soon so they can it overseas.

Hello Orimai,

Once the I-130 is approved. It could take around 2 months for NVC to process your docs then send it to Manila Consulate. Then around 1 to 2 months for your wife to be interviewed. Please check the NVC Flowchart for I-130/CR-1 for more info on what to expect in the next couple of weeks.

You can still file for K3 but it will take 3 to 6 months for the whole process so I may say that CR1 for your wife will be the best route for you.

Hi. I dont have any visa yet. Just the I-130 was approved and my lawyer said they are going to submit the I-129f next. I am here because it confuses me why they would want to pursue a K3 now that the I-130 is approved, when I keep hearing either it's not possible or there are 2 choices, the K3 or the CR1. Personally all that matters to me is what will get her to the US the quickest.

If the I-130 is already approved, there's no point in sending in the I-129F, its just your lawyer wasting your money.

Go have a look in the flow chart for the I-130/CR1 process. It'll still be a few months, but it'll be faster than the I-129F. Check some timelines for others from the Phillipines.

I-130s to CR1 used to take a couple of years, they don't anymore, and in some cases, they're faster than K3, even if the I-129F was submitted in a timely manner.

I don't know much about spousal visas but wanted to wish you the best of luck. I love Cebu, have some really great times there. My wife is from Cagayan De Oro on Mindanao. Anyway, Good luck :thumbs:

You need to talk with your attorney and find out why they want to submit an I-129f now and did not do it earlier. Don't let them spend your money without your understanding and agreement.

The President of "fastk3" alledgedly went to law school (doe not say he finished) and resides in Thailand and leads a legal team of 25 people. The other dude on the site indicates he is an attorney based in Colorado and is a memeber of several different bars.

They are right. You should continue your I-130/CR-1 application since it was approved already.I think thats the best thing you should do.

I agree with what most are saying here... go with the CR1 immigrant visa instead of the K3. If the K3 papers had of been filed when the original NOA1's where received it might be a different story and I would definately ask your lawyers why they were so slow in submitting the paperwork till waiting for approval of the I130... they only needed the NOA1 from that.

Why everyone else is saying go with the immigrant visa... well... have a read of peoples timelines in their signatures and you will get an idea of processing times before it goes to consulate, and also check the times for processing at missouri for the K3... If your K3 is submitted now and you continue with the CR visa they would probably both end up at consulate at the same time... in which case the K3 would be ignored and would then be just a waste of money.

We really appreciate the information :) Ken is the lawyer in Denver CO, Dennis is the owner in Thailand. I have written both of them and Ken says he is starting a trial this week, has to get back to me next week and my contact (who does the paperwork, Nena in Bangkok) doesnt answer my questions so I am looking for alternative methods to finding out what needs to be done. I asked all of them whats next and that we are concerned, Ken and Dennis never got back (over the course of a week) and Nena only wrote the following.

"will send your petition (I-129F) and all documents to the USCIS inChicago. This forms for running process for you."

Other than she needs us to sign new G-325A's, thats all the letter said and is why I assumed they are persistant on the K3. I regret using FastK3 for various reasons. This is just one. The name of the business (FastK3) would suggest they may refuse me to even pursue a CR1.

The reason they did not submit the K3\I-129F is because I never did receive the first NOA. They had told me I could forward my postal mail to a family member while in Cebu. I did and the NOA was returned to the Nebraska Service Center as undeliverable. I never did receive the NOA, the website said the I-130 was approved on the 16th. I cancelled my mail forward on the 13th from out of state so we are praying it cancelled in time to receive the approval letter.

Now that the I-130 is approved, do they still need to send a copy of the receipt in with the I-129F?
