My wife came from Thailand to Texas on a K-1 visa and her daughter followed on a K-2. They are now permanent residents. My step-daughter is seven years old and has lived with us in Texas for four years. Her biological father from Thailand denied she was his child, but my wife still put him on the birth certificate. We have a Thai document stating that he has no claim to my step-daughter. I do not even know if we could locate him if we tried. He has never attempted to contact my wife or her family about this matter.

I was hoping for some wise advice or that someone could steer me in the right direction toward adopting my stepdaughter.

If he denies being the biological father then how is he on the BC? Apparently he did not sign the BC if he does not claim the child.

Although he denied being the father my wife knew he was and put his name on the BC.

This is common in Thailand. If we know who the father is we must put that name on the BC. The father doesnt have to sign it. Many times they do not because they fear legal problems. The father many times isnt a legal husband to the mother. Marrying these men gives them legal access to our families assets so it is also common not to marry.

If the adoption process requires the fathers signature on anything you can be sure he will ask for a huge amount of money. This is his only chance to make money off this child and he knows it. This is also common in Thailand. The parents will use the kids to extort money at every opportunity.

Please let us know what the document is called that indicates she has legal custody of the child. How did she get this doc? Were there any problems at the embassy in getting the childs visa due to custody? This info could help many others.

My wife got a document from the district office that states she was never married to the biological father. Apparently this was enough because immigration never questioned us about the father. The K-2 process was very smooth. I am not as sure about the adoption process? I have a consultation set up with a lawyer.

I believe what you say here of course but this is very different than a case I know of where the circumstances were exactly the same. In that case the embassy demanded and got not only a letter in both languages but made the mother bring the father into the embassy for an interview. The mother had to dealwith this situation for months to get it done. Then we see your case where it was seemingly easy. Just proves you never know how it will go in BKK.

All I know about adoptions is that they can be difficult. But with your history it will probably be simple. Lets hope so.
