We went down to the Socail Security Office here in Stockton an everything went well thanks to the work authorization evidence (no EAD needed for SSN/SSC with K-1 Visa) paper we printer from VJ. They were about to protest before Andy reached into our stack of papers (can never be too prepared) an smacked it onto the desk sayin' "nope read this here" then this frilly little guy scurried off to get someone who knew what they were doing as he could tell we did heh! Anyways a nice dude in a chair also came over to help us an made sure to check that no rules had been changed (an they hadn't) an also asked a co-worker on fiona's likelyhood of being accepted (she won't be we just need an officail denial from the Govt. so that we can get her set up with another program) for SSI though it was too late in the day an we took the dudes name after getting everything slipped through with the intent to go back with 4-5 days if not tomorrow for the denial. Her Socail Security Card should arrive in the mail within 7-10 day's :dance:

Very useful info to be armed with!

RM 00203.500 Employment Authorization for Nonimmigrants:

Table 1. Aliens Work Authorized Without Specific INS Authorization:

The following lists nonimmigrants, by alien classification, who are authorized to work in the U.S. without specific authorization from INS. The alien’s I-94 will not have the INS employment authorization stamp and the alien will not have an EAD.

For those with an asterisk, the principal alien, spouse, and child all have the same visa symbol.

K-1 Fiance(e) of U.S. citizen

Kind of makes me wonder why apply for EAD when a K-1 visa holder is authorized to work with out it according to Social Security Policy RM 00203.500.

If the child is ineligible for SSI due to your income and/or resources you can call SSA 800-772-1213 and say you want to inquiry about the child's eligiblity for SSI once they determine you income and/or resources are too high they can send a an SSA-L991 informal denial notice. That might save you trip back to the SSA office.

Next thing lets say a K-1 is authorized to work without an EAD card, the K-1 status is only good for 90 days, so after 90 days you have no authorization to work without an EAD card.

Once upon a time SSA required a K-1 to provide an EAD card or work authorization stamp like the one still given at JFK to be assigned an SSN. SSA changed their policy because INS was having trouble getting EAD cards applied for under catagory A6 out to K-1s before the K-1 status expired.
