Applying h1b visa with history of denied visa

Hi! I used my H1b 6 year limit in the states. I had a greencard EB2 category but this was denied on I-140 stage because of inability to pay (employer). I am planning to go back to the Philippines to reset my H1b visa for 1 year. Does anyone know whether my history of greencard denial could be used as a reason to deny a new H1b if I apply after 1 year? Would it be safer If I get an h1b visa from a united states university? Thanks!

As the H1B is dual intent, your previous failed attempt at a greencard should not matter.

Not sure what you mean with a H1B from a university- do you mean an F1 student visa, or do you mean a university as employer for the H1B? If the latter, I do not think the employer matters.

It is thru the University as an employer. They are cap exempt. I am just worried that if I go thru consular processing that I would have the chance of being denied. Consulates in a foreign country are very different as they can deny you for anything and not have to tell you the reason why from what I have heard. I was wondering whether anyone has had this experience
