Responding to RFE tax related same than I e-file for late IRS overseas tax return

There is no extra fee for trying with a tax return copy.

Yes I know, just not sure that they will take it....I will just put the forms 1040 and 2555 as I don't have any W2 and my tax return are in euros and in French so I don't think it will be a good idea to put it, it will just get them confused....

They would only be interested in a US tax return, which would NOT be in French?

Let me rephrase that.

I will send them copies of form 1040 and form 2555.

And that's it, I will not be able to send any W2 of course and also not any equuivalent of W2 because it is in French and in euros.

Would thoses 2 forms be enough all alone or do I have to wait for the transcript??

I want respond quick to that RFE........

What they want is a copy of a complete tax return. Whatever you would have included when filing by mail, you include. They won't be expecting a W2 when there's no US income.

Well by mail my tax preparer told me to just put thoses 2 forms 2555 and 1040. That's it! Nothing else...

It that's all you were required to mail to the IRS, then fine.

IRS didn't take my e file return cause I don't have any taxable income.

So my tax preparer was right. I just mail my 2 forms to IRS and a copies of the 2 forms to respond to the RFE, they will probably not take it but at least it will give me extra time to get the transcript!!!

Now waiting for the IRS to process my forms................they say 6 to 8 weeks!!!!!!!!!!

We had the same questions about my husband's tax returns and he didn't file for 3 years since he had 0 or not enough income. So we called the IRS 2 weeks ago, it is not necessary but allowed to file a tax return even if you had 0 income in USA or abroad. So we decided to do it to make things easier afterwards for the CR1 procedure that we're going to start in a few months.

We are married since dec. 2010 and he lives in France with me since june 2011.

Here is what we did :

For 2009 and 2010, he filled 1040ez forms as single.

For 2011 since we were married, he filled a 1040a form and also a W7 so I can get an ITIN.

We sent the papers 2 days ago so if you want, I will let you know how it turns out.

While I think this is correct we did receive an RFE during AOS asking for a W2 from my overseas employer. Whoever was looking over our case sent an RFE asking for a document that did not exist.

I sent quite a few things - I got a letter from my former employer stating that they did not issue W2s, I printed out a page from a government website stating that there was no income tax in that country, I also included a salary cert I had (standard issuance in that country) but I think what did it was the letter from my wonderful accountant citing tax code that stated foreign companies are not required to submit W2s and then something about foreign employment not being considered employment for FICA and FUTA purposes. I also resent my Form 2555 showing my foreign income earned.

A simple, "Hey dimwit! This is foreign income, so there's no W2." would have sufficed.

That's what I sent the first time - salary cert plus letter explaining it was foreign income and they sent me the same RFE for a W2 again. Hence why I overdid it on the second response. I left the dimwit part out though.

So you mean you got 2 RFE for the same reason.

Cause I am getting worried if they don't accept copies of my 1040 and 2555, they will not denied my application but send me another RFE?
