Responding to RFE tax related same than I e-file for late IRS overseas tax return

Hello,

I love the site it help me so much.

And here I am again looking for answers.

I just got an RFE for federal tax information.

We lived abroad and never filed.

They are saying: you must provide either an IRS tax transcript or a photocopy from your own records of your federal income tax return for the most recent tax year, 2011.

I will file electronically.

Now my question is can I respond to that RFE the same day? What will I have to send in?

Do you think it is risky?

I just can not wait for the transcript than will takes weeks if I am lucky.

Any help, advise, similar cases will be gratefully appreciated.

I will file and for sure print a copy for myself.

Where do I find a W2 as I didn't earn any money in the state?

If you had no US earnings you would have no W2 form.

You don't need to worry about a W-2 form, you need to get your tax transcripts. Since you are late filing they now require the tax transcripts:

Instructions from the I-864:

"If you were required to file a Federal income tax return during any of the previous three tax years but did not do so, you must file any and all late returns with IRS and attach an IRS-generated tax return transcript documenting your late filing before submitting the I-864 Affidavit of Support."

They are asking you for a photocopy as they are just assuming that you forgot to send it to them with the AOS.

Now I am wondering if I can say than I was not required to file a federal income tax return under US law because my income was too low.

Cause it was too low.

IRS told me than didn't need to file d'or the past years for that reason.

Yes you are right.

I will have to file and then I will get the transcript directly at the IRS office, hope it won't be too long.

Luckily for me they are just asking for 2011 so I might be able to e file, waiting for my favorite tax men to respond on that

By the way does anyone know once you file tax return for previous year (for me 2009) hw long does it take to be able to order tax transcript. I will be owing. So I guess NVC needs documentation of payment arrangement also......Sorry to add this to your thread. Hope you don't mind.

Not able to e file.........

Do you think I could try a letter to IRS explaining that I am in a rush cause my all application is on hold especially EAD card.

Would they even care?

Any advises on similar cases??

I don't believe the IRS has an expedite process so not speaking from that type of experience. What I would do though is get the taxes filed and just send a copy of your original tax return.....it won't hurt and the NVC may accept it so that way you at least get through the process quicker. Request the tax transcripts and make sure they are brought to the interview.

There is no extra fee for trying with a tax return copy.
