The reason I ask this is it looks like I got jipped a month. My NOA2 was July 2, 2012 but it is valid from June 8, 2012 to Ocotber 7, 2012. Now I am very optimistic that we will get our interview date before October 7, 2012 (I've got a NVC case #, is supposed to ship out Monday and packet 3 is ready to go EMS as soon as the petition is at the consulate) But, what if they give an interview date beyond October 7, 2012? What will I need to do then? It's amazing the time they take and then they want us rush through everything in basically 2 months! :angry:

if the NOA2 expires before interview then yu start all over again. Thats my understanding. If you already submitted, the consular officer can extend the 4 months at their discretion. I think i read about that here. read almost almost every posting. Time flies. for me if i have NOA2, am doing medicals immediately. its valid for six months and even book interview

I think i read about that here. read almost almost every posting. Time flies. for me if i have NOA2, am doing medicals immediately. its valid for six months and even book interview

For whatever reason my NOA2 is valid for only four months but the notice date is July 2, 2012 so it's effectively 3 months. With a month to get it to the NVC and then to the consulate, that gives my NOA2 a 2 month life, seems a bit tight to me!

thats the bureaucracy. Looks like our NOA2 took one month to reach you. Its for months validity from issuance to interview day. If u have interview on the day it expires, you still ok but not after midnight of the expiry day

No, it didn't take one month to reach me. I got an e-mail on July 2, 2012 that it was approved. Got the hard copy NOA2 in the mail July 3, 2012 with the approval date of July 2, 2012. But, it's validity date started running a month before they appoved it. Could this be right?

What are you talking about?

If the NOA2 expires, the consulate generally extends the validity date. Plenty of people get interview dates past the date of their NOA2. Mine was.

OP, I suggest contacting your consulate by phone or email, but I'm sure it will be fine.

Uhmm, no. The consulate can extend the expiration of the NOA2 so you can have your interview. You do not start all over again.

What are you talking about?

If the NOA2 expires, the consulate generally extends the validity date. Plenty of people get interview dates past the date of their NOA2. Mine was.

OP, I suggest contacting your consulate by phone or email, but I'm sure it will be fine.

I agree. They tend to automatically extend the expiration date, but just contact your consulate so you can be sure your expiration date is extended without any hassles.

My Petition Expired – Can It Be Extended?

The I-129F petition is valid for four months from the date of approval by USCIS. A Consular Officer can extend the validity of the petition if it expires before visa processing is completed.

I agree. They tend to automatically extend the expiration date, but just contact your consulate so you can be sure your expiration date is extended without any hassles.

the relevant word u are missing out from the state departments website is CAN. It says " A consular officer CAN extend the validity of the petion..." It never said " A counsular officer WILL extend the validity of the petition...". the two are very different. Its a discretionary power, not an absolute right you have as an applicant to be granted to you. So my advise is proceed and plan as if you will not be granted the extension. Its not guaranteed. Its a discretionary power and as such dont bet on it. take it as a suprise if you get it. this is a well crafted legal statement and if you are not granted extension, they can easily say that we posted CAN nad not WILL".

I know how to read and know what it says there. And yet I have not seen anyone post about not having their expiration extended so they are able to have their interview and finish their K-1 visa processing. I have seen a post about deciding not go through with it and then changing their minds after the NOA2 was expired and still being able to interview 7 months after receiving their NOA2. The consulates know sometimes there are hold ups and waiting times and that an interview is not available until after the NOA2 expiration date. This is why a lot of the time they just automatically extend the date.

And my thoughts for you is to stop scaring people with nonsense statements like "if the NOA2 expires before the interview, you have to start over".
