He was on a work visa here and he left 14 days after it expired. I hope it doesn't cause a problem...not that we are telling. Anyway, any help we get would be greatly appreciated.

LucynFer - If he was on a work visa and overstayed by two weeks, you need to tell them that - he will be under oath. Did you tell the truth on the forms you filled out? It will not be a problem but lying will get you into deeper trouble - they already know he overstayed.

You are lucky they actually told you the date the packet was sent! I cannot seem to get them to provide me with that information.

Oh my gosh...our petition was received at CDJ on Oct. 6 too...I hope that means our packet is being sent too...on Thursday when I called, the woman said it was still being reviewed and that it takes 4 to 6 weeks from when they received it.. How did you get an email? Did you email them first? If so, what is the email address?

You just gave me some hope that I'll see my honey soon (at an interview).

It doesn't seem like you'll have a problem from what you say in your post :) From reading different posts here in VJ it does seem like they ask about the same questions during the interviews, but you never know.

I think that what they ask also has to do with what they see in the application they get at the time of the interview :unsure:

Oh, and I wouldn't worry about the packet they'll send out to him. The USC gets it too, and even if he doesn't receive his in Mexico you can head to CDJ as soon as you get yours in the US :yes:

i e mailed to cdjimmigrantvisas@state.gov it usually takes them 2-4 days to reply but they have both times just make sure to include your cdj number that nvc assigned to you try to do it it helped us to feel better to have some info good luck

I guess I'm a little behind most of you. I'm still waiting for NVC to get my papers. I called Friday and they told me they hadn't received them yet and to start calling back the first or second week of November but that it could take up to 90 days for them to receive them.

I guess I'm a little behind most of you. I'm still waiting for NVC to get my papers. I called Friday and they told me they hadn't received them yet and to start calling back the first or second week of November but that it could take up to 90 days for them to receive them.

My guesstimate is 3-5 weeks from CSC to the NVC (90 days is pretty unlikely) and 4-6 for CDJ to send out the official package as they seem to run security checks of some sort too and then it takes them a while to "enter the fiance's personal data in their system" before they send the packet. By the time my fiance gets to CDJ it's gonna be COLD there!

Do you realize that still the worse case scenario is 11 weeks= 3 months :o

At this point I'm a firm believer in Mr.Murphy, so I'm just trying to get into my head that I won't be going to CDJ until late January :cry:

I guess I'm getting more frustrated then ever at this point because I'm trying to plan my next visit but don't know how to. My fiance really wants me to go to Juarez with him since I know the city. I want to see him before the end of the year though. If I go see him before the interview we won't have the money saved up again for the interview until about February. I keep on hoping that the interview will be in December and then I can take one vacation and see him while he is there for his interview. But I can't stand the thought of not going to see him now and the Juarez Embassy not even being ready for his appointment tell February anyways.

Sorry I'm done now. I just want to see him. This is the longest that we have been apart since he left for Mexico in January of this year.

I notice that by now, you seem very well versed on immigration laws. I guess at the end, many of us will become experts of sorts. Anyway, I have one more question for you. I keep reading about waivers. What is that? and who needs them? and how do you know if you need it? I am hoping to hear something soon, so I would appreciate any assistance in that area. I have filled out all the forms myself, so I want to know if there is something I might be lacking. Thanks,

Hi Lucy, waivers are people who would be otherwise inadmissable for a variety of reasons such as overstaying a previous visa, being in the country illegally for more than six months, misrepresentation, submitting fraudulent documents, etc.

Unless your fiance falls into one of the inadmissabilities, you should not have any need to deal with the entire waiver process which is difficult and long.

Lucy, I just realized that you are concerned because your fiance overstayed his work visa, right? Technically a 14 overstay will not create any problems. (The bans kick in when the person has overstayed more than 180 days and then left). But the bigger problem you *may* have now is if you lied on the forms and/or if he lies at the interview.

Take a look a this thread for a little more information. You may be able to clear it up at the interview without a problem, assuming all of the dates and information on the necessary forms in the fiance packet are 100% accurate. But he cannot lie under oath about the overstay - this is where deeper problems will start. You also may want to do a consultation with a qualified lawyer to get some legal guidance on how best to procedure.

I just called Juarez (I'm probably driving them crazy hehe) and they said my fiance will recieve his packet in 2 to 3 weeks. Woohoo! Now let's hope 2 or 3 weeks doesn't turn into 2 or 3 months hehe

OK chiquitas, I finally got the "Fiance Packet. It took a little more than four weeks from the day they received the file from the NVC.

All of the paperwork in the envelope is exactly the same as on their website, but the copies are very bad and the forms are all outdated (!!!)

It's a brown 8x10 envelope with the following return address: "American Consulate General P.O. Box 10545 El Paso, TX 79995-0545

1) The letter: "This office is pleased to inform you that it can begin to process your fiance visa case. Please read and follow all of the enclosed instructions very carefully". The letter includes his case number.

2) Notice about payment of visa fee at Banamex - same as website

3) Instructions - same as website

4) Evidence to meet the public charge provision - same as website

5) Instructions for medical exam - same as website

6) DS-156 forms - "Solicitud de Visa de no immigrante" outdated and almost impossible to read

7) DS-156 form supplement" Solicitud de Visa de No-Immigrante para prometido - outdated and almost impossible to read

8) Letter of intent

I'll be scanning and emailing it to my fiance tomorrow and hope to make his flight arrangements for around two weeks from now.
