KITKAT .. te mando un abrazo...did your fiancee file a Form I-212, Request for Permission to Reenter after Deportation or Removal along with the waiver? I read this from the ling agro sent: (INCREDIBLY HELPFUL!! thanks Agro.. :whistle:

*The number of formal denials has increased from last year, but it is in line with the increase in workload. For example, last year the consulate referred a total of 3,900 applicants to the USCIS office for waivers, while in the last month alone it referred 1,213 applicants. Applicants who know they will be denied at the consulate based on unlawful presence, fraud, or criminal convictions cannot submit the waiver prior to leaving the United States or prior to the consular interview. This is because the consulate must first review the application, weigh all the possible grounds of inadmissibility that might apply, and make a formal determination. In contrast, applicants who will be denied based on a prior deportation or removal are allowed to submit the Form I-212, Request for Permission to Reenter after Deportation or Removal, at the USCIS district office having jurisdiction over the deportation/removal, and have that adjudicated prior to the consular interview. But applicants who will need to submit both an I-212 and an I-601 waiver are instructed to submit both at the time of the denial at the consulate.

I stil dont know if Im gonna need the waiver.. But I will be prepared .. emotionally!! and with paperwork..

KITKAT, the extreme hardship is just for the US citizen? or could apply for the foreigner too? I mean.. I know is a silly question, but since I read all in english Im confussed.. WHO has to suffer in the evidence provided for a waiver??!! :wacko:

Brenda, a 212 waiver is for people who have been deported. My fiance was not deported and did not need this.

The 601 waiver is written by the US Citizen and only applies to him. He is required to prove "extreme hardship" to the himself only in the event that your visa is denied and he is required to relocate permanently to Mexico. This requires a well written and detailed harship letter along with as much evidence and documentation as possible - the more, the better. Also, the information from CDJ was from more than a year ago so it is somewhat outdated. Approval rates continue to be very high although they are taking a long time. They have hired more staff to process waivers so hopefully that will have an impact in the near future and shorten the timeline.

Happy New Year to all :)

My fiancée had her interview Dec. 26 and all went well.

She had her medical exam on the 26th and her interview on

the 27th.

She said the interview was short only asked her 4 questions and looked

over the paper work.

How long have we known each other?

Where did we meet?

Where do I live?

Did she have any Children?

Am I correct in assuming that if we didn't have to fill out an I-601 waiver she

would have been approved? The reason given to her why they needed the waiver was her

overstay. She needs to return to Juarez Jan. 10 to turn in the I-601, supporting documentation,

get finger printed and pay.

Now we have to get ready for the long wait, any update on how long the I-601 waivers are

taking to get approved. I know that they recently hired more help.

Hi Pat,

It's great to hear that everything went well and was smooth! Congratulations! You are correct that had she not had an overstay she would have (normally) been approved at the interview. But as long as you have the hardship letter ready on Jan. 10, you are in good shape. They are still very backlogged at CDJ with waivers but hopefully they will start to make some progress with the new help in the coming months. Right now they are telling people 9 months (+ 7 weeks after approval she will return for visa pickup) but hopefully the reality will be closer to 6 months total.

Guess what everyone? I finally have a date for my fiance's interview. My fiance finally bought his tickets, for Jan. 28th thru Feb. 1st, so we have the dates set. At first I was a bit disappointed because I wanted him to go right away, but I have to understand that he has work obligations, etc. that don't allow him to make the trip when I want. :P The good thing is that the dates are set and I am so relieved at least he has the dates set. By the way, he's flying thru Aeromexico from Guadalajara to Juarez on a direct flight and the ticket cost 350 dollars (roundtrip), pretty good deal.

We are in the same boat i think. NVC said it was sent to Juarez on 12/10. Juarez has no record of it when I call, and I have sent two emails requesting info and have not received any response.

Where do you call to have NVC track it down?

Just got back from visiting Leo over New Years. Had a really good time. I took back 90% of his stuff with me. We are so excited that this time next week Leo will be in the embassy getting his visa. I'm still SO NERVOUS about everything.

E & K - good luck today with interview.

Danielle & AgRo - hopefully you will hear some good news next week about your packet. It should be any day now. They are probably just a little behind with the holidays. Now everyone is back in full force to work.

Thanks for the support ladies!

Danielle - To reach the NVC I called the number on the letter the NVC sent me when they sent the case to CDJ. There is an option for fiance visas which connected me to an operator. She said that CDJ had to have physically received the package they sent because otherwise it would indicate on her screen that it was not received. She could not give me the tracking number nor could she tell me the exact date my file was received as it goes in a package with other cases, but she said that it was definitely received and if CDJ can't find the case, it is no longer the NVCs problem.

I wonder why CDJ doesn't respond to your emails. We always write them in Spanish, and get all kinds of responses back which never really tell us anything, so I guess we are still in the same boat. I will continue to pray that we both hear something soon or just receive the packet!!
