The embassy is driving me insane really, I am going insane. Please read the following and you will understand why, I don't know what the hell to do??

Dear Ms V:

Thank you for your February 5, 2010 inquiry regarding the immigrant visa case of XXXXX (CDJ--------). On June 6, 2007, a consular officer found Mr XXXX to be ineligible for visa issuance under section 212(a)(1)(A)(iv) of the Immigration and Nationality Act. Under this section of law, any individual who is determined in accordance with regulations prescribed by the Secretary of Health and Human Services to be a drug abuser or addict is ineligible for visa issuance. There is no waiver available for this ineligibility. A panel physician/psychologist at that time determined that Mr XXXX had a Class A medical condition for drug abuse in accordance with the standards prescribed by the U.S. Public Health Service’s technical manual for the examination of aliens. The doctor who conducted the exam determined that his use of drugs was more than experimentation. The panel physician alone makes the determination of Class A ineligibility based on medical tests and the applicant’s own statements. To overcome this ineligibility, Mr XXXX had to demonstrate that he had entered remission by remaining drug-free for at least three years from his last drug use, which was determined to be December 2006.

Mr XXXX returned on to the same panel physician on February 2, 2010. Mr XXXXX was unable to demonstrate that he has entered remission to the panel physician. Mr XX made statements to the panel physician which contradicted his exam conducted in 2007. The panel physician has therefore recommended that Mr XX

return for a medical re-evaluation in six months. The panel physician also recommended that Mr C ld undertake a Narcotic or Alcoholics Anonymous program in order to maintain sobriety and learn relapsed prevention strategies and/or attend individual counseling oriented to adaptive behaviour.

My reply to this correspondence was:

X was banned for 3 years for using marijuana once in December of 2006. We served our 3 year ban and X came to the interview with proof of rehabilitation. However, the psychologist put it bluntly to him that "any proof of rehabilitation is bullshit (verbatim) and that neither HE NOR THE CONSULATE would take his proof of rehabilitation into consideration” for his visa therefore REFUSING to inspect his documentation of rehabilitation. The psychologist also added that it was ONLY HIS medical opinion that mattered to the consulate. It has been determined that X received his ban due to smoking marijuana once in Dec of 2006. He served the 3 year ban and returned to the consulate with medical proof of rehabilitation however that proof of rehabilitation was REJECTED by the psychologist. The psychologist NEVER ONCE mentioned anything about obtaining further rehabilitation as your email indicated, that is untrue. Nor did the psychologist of 2007 recommend rehabilitation, we had to find that out on our own. Since the psychologist told my fiance that the consulate does not accept rehabilitation we concluded that the embassy preferred to do their own drug testing by being given the 221g form saying to come back in 6 months for another medical. If there were ANY DOUBTS about Edgar's drug use, he should have been delayed in Juarez to conduct a hair analysis as other applicants have been allowed to do to prove his clean status, but he was not, he was SENT AWAY with barely any information and NOT asked to present his proof of rehabilitation by the consular. The psychologist had already rejected the proof of rehabilitation my fiance had with him which consist of 2.5 years worth of clean urine tests taken every 3 months throughout the ban period. You requested the 3 year ban for the incident in December of 2006 and we complied. When we returned to provide rehabilitation documentation to the psychologist we were TURNED AWAY and lied to by the psychologist.

I would not expect an officer of the consulate such as this psychologist to use profanity while talking to my fiance by stating that his proof of rehabilitation is “bullshit“. Regardless of any discrepancy between what was said in 2007 and what is said now, the fact remains, the last time X did anything was December of 2006, the law says 3 years, not 10 years, X is 24 years old so if he experimented when he was 14 years old by succumbing to peer pressure that is beyond this matter and shouldn‘t be an issue. The mistake he made in December of 2006 was just that, a mistake. It is my request that this case be transferred to a senior consular for review immediately. X has proof of rehabilitation. We just need to know what to do next to arrange for the consulate to receive that documentation. I am hoping that the appt set for six months from now can be waived and have our visa issued to us so we can get married.

What exactly does this mean? Does he get another chance in 6 months? I'm so sorry. We try to do the right thing only for it to come back and bite us.

Yes it means to come back in 6 months with proof of rehab and do another medical.

I don't trust these psychs, they LIE. The psych rejected my fiance's proof of rehabilitation, now the consulate is sayiing my fiance did not have proof well the psych refused to look at it!! :crying: they are driving me crazy!!!

December 14, 2009 - Received a reply from the consulate saying that they will forward a request to the immigration department to request a new appt

December 16, 2009 - Received an email from the consulate saying they are ready for my fiance to come for an open appt anytime

February 2, 2010 - Medical - Trip back to Psych far away in dirty office

February 3, 2010 - Pick up Medical Results

February 4, 2010 - Interview, given form 221(g) "Admin Review" and to come back in 6 months for another medical examination. #######.

Like anywhere else, it sounds like they have a quota to meet. (X amount of rejections per month or something) I'll pray for you both. Keep your head up. This is just gonna make yall stronger and closer.

A quota? Are you SERIOUS? Thank you so much for your prayers - I really appreciate that, this whole thing is making me broke - it costs a lot of money to send my fiance to the border on a moment's notice -

I can't see having to wait six more months, since I wrote back I'm praying that they see what has happened and just gives us our darn visa.

A quota? Are you SERIOUS? Thank you so much for your prayers - I really appreciate that, this whole thing is making me broke - it costs a lot of money to send my fiance to the border on a moment's notice -

NO!!!! The quota is just my smart-alecky assumption. I have no idea. I know what you mean about money though. What kind of relationship evidence did you have? That's where we're stuck. I sent a ton of pictures of us with family members and hundreds of border crossing receipts. I don't send him mail because chances are he'll never receive it and of course he doesn't have a computer. Sigh.... any ideas?

TwoinLove, I really hope they let you submit that evidence of rehab. They are being really unreasonable.

I think you should do what the Casablanca people do for a denial like that, which is contact their their Congressman to keep the petition at the consulate and request an extra interview or opportunity to present more evidence. I think you need evidence that the two of you keep in contact as well, such as emails, phone logs, etc.

There are tons of cyber cafes in Mexico, for like a dollar an hour, maybe he can go over to one of those and send emails to you online - that is what my fiance and I do, we've been doing that for years.

I found emails between us but they are not his own personal account. He's not too tech savvy. We emailed each other through a mutual friend at work. It's the best I have. I printed several of emails between me and our friends talking about me and Adolfo and our plans and they would give me messages from him too. Also, there are a few messages about my soon-to-be mother-in-law being sick and my SO asking for money to take her to the doctor and stuff. Also an email to my old boss that lives on this side of border but works at the plant asking her if I could send stuff to him via her address. I have a couple people writing letters for us testifying that they have been out with us and know all about us and even worked with us plus letters from kids and my dad who lives with me. How does this sound? I have a prepaid phone so I don't have phone records but I already sent hundreds of border crossing receipts and pictures.

How about Western Union receipts, have you ever sent him cash? Just make more emails - he has to get to a library or a cyber cafe and start writing back and forth love notes and ecards etc. They are paper pushers without brains so the more paper you put in front of them the better.

I don't have any receipts. I guess I thought it was all cut and dry. I was even there two weekends ago taking him his paperwork and I didn't keep any receipts. I don't know what I was thinking other than we had enough evidence. :bonk:

Hello all,

I have been reading posts on this forum and what to thank everyone that has shared their experiences to let me know what I have to look forward to :D

Here is my situation I am looking for advise on. My SO has been here visiting me for the past 5 months on his tourist visa but is getting ready to go back to Mexico next week. From what I have read all the info for packet 3 can be obtained online and I have noticed a few people say they did not wait to get their acceptance letter and just got a copy in Juarez. So if we do not hear anything in a couple of months he wants to come back to the US and wait so we can fly to the interview together. Can anyone tell me if he has to be in Mexico while waiting to go to the interview?

So after being in C. Juarez for two and a half weeks now, my fiance and 3 soon-to-be stepsons were given the final thumbs up on their k1/k2 visas yesterday. Fiance picked his up today and the kids' packets are ready also and will be picked up tomorrow!

Crossing tomorrow night and flying from El Paso home on Thursday. SO excited!

If you have any K1/K2 questions about the Juarez Consulate, ask away. Thankfully he had family there or 2 1/2 weeks would have been super expensive!

Congrats on your K1/K2! I guess you are lucky for getting those since this forum is dying and looks like no visas going thru juarez at least from this thread. I'm still waiting going on 4 glorious years now for a 3 month K-1 VISA! Hooray! I imbecils at Juarez still can't make up their minds and are having fun jerking us around yay! Idiots. Anyway, after the jerk us around again 6 months for now and another $1200.00 goes down the tube for their ignorance, that's when my fiance and I will just get married in Mexico. I will sell my house in the USA that I worked so hard for, quit my great job with Merck Pharmaceuticals to go work in the country for pennies and where my skills are not needed anywhere - well we will probably be poor for the rest of our lives but at least we will be together and the food will be good, that is if we can afford to eat! :) Gotta love the imbecils at the Juarez consulate, they will prob reject my fiance again in the next 6 months and he won't be able to go to law school in the states because he's been classified as a "Class A" drug addict by the United States consulate because he tried coke once when he was 14 years old! Aren't they just ingenious to put labels like that on people who experimented when they were teens over 14 years ago? Geniuses they are! So, because of their idiocy, I will lose everything and life will just be a toss up. I hate Juarez! Don't trust them and above ALL, do not trust the medical people or the psychiatrists, they LIE LIE LIE LIE LIE.
