You're not the only one with the procrastinating fiance, mine also barely got his passport, last week. Well, he went to go get it, but it's not ready yet, he has to go pick it up this week. It doesn't take too long to get the passport though. He went like on Tuesday of last week and they told him to go pick it up this week, so don't worry too much. Just tell oliverio to go soon. Do like I did, just tell him that you need it NOW, no more waiting, scare him a little so he goes, sound a bit mad when you tell him, I bet it will work :D

He's driving me crazy!! hehe I told him a month ago that if he didn't have his passprt for the interview, he won't have an interview and it's going to take even longer to get his Visa. I tell him that everytime we talk....I think it's just now starting to sink in a little hehe I talk to him tomorrow so I will try your way and let you know if it works...I hope it does. I'm about ready to fly down there and do it myself :P

Here's our story (the short version) for all of those who don't know me yet...

Feb, 2005-Got engaged

August, 2005-Filed I-129F

November, 2005-Went to medical and K-1 interview in Juarez. Medical went very wrong. We were sent to see a psychiatrist as follow-up but didn't know why. Consulate closed three days for Thanksgiving. Javier went to the interview the following Monday on his own. He was found inadmissible due to "drug addiction" based on two admissions: 1) he had experimented with cocaine a few times in his teenage years (approx. 10 years prior) and 2) sometime in August, 2005 he stuck his finger in a bag of cocaine and tasted it, for the purpose of determining what it was (men brought it onto the farm property where he lives and works with his family; he had seen cops use that method of determining what a substance is, so that's what he did). Javier called me around noon and said he had a 3-year "castigo." We are ineligible to receive any Visa until August, 2008.

December, 2005-Attorney filed Advisory Opinion directly with the Department of State, along with a Motion to Reconsider with the Consulate, in hopes that they would fix their mistake.

March, 2006-I get in touch with the man who adjudicates the Advisory Opinions; he doesn't have ours, requests that we re-send. Attorney re-sends.

August, 2006-I go to Mexico, marry Javier (we decided if we're going to have to wait, we might as well make the best of the wait time).

August 31, 2006-DOS man requests ANOTHER copy of the Advisory Opinion.

September 1, 2006-DOS man mails out denial notice to attorney (after all that, took him one day to decide). Contents of denial notice are at least half factually incorrect (far be it from them to practice any due diligence when dealing with people's lives).

September, 2006-We decide to stop fighting and accept the injustice that was dealt us.

September 7, 2006-I file I-130.

September 11, 2006-NOA 1 for I-130.

Now-Waiting........................

Near Future-HOPING Congress passes CIR, which would eliminate our need to file the I-601 Waiver. At that point, we file our I-212 Waiver ahead of time (after I-130 approval). Hopefully that will be approved in a timely fashion. Meanwhile, I-130 makes its way through the NVC to CDJ. It then sits at CDJ for the approximate year that it's now taking to get the interview. This timing should land us right around August, 2008, when his ban is up.

If all that happens, in August, 2008 we'll go to his interview, pay $2,000, and get his Visa. Worse case scenario, the I-212 isn't approved yet, and we would have to wait further.

If CIR is not passed, we will file I-601 and I-212 concurrently at the interview in August, 2008. We would then have to wait for those to be approved, meaning the earliest he would be home is sometime in 2009.

In the meantime, the Consulate CONVENIENTLY failed to notify Javier at his interview that he needed to undergo rehabilitation/counseling and provide proof at the next medical. We were able to find that out ONLY by e-mails from myself, the attorney, AND a Senator to the Consulate. We are having Javier undergo regular urinalysis drug tests (every 3 months) but are having a hard time getting him re-hab for a drug addiction that he doesn't have. Consulate conveniently likes to gloss over that little issue in any and all e-mail correspondense.

I hope you have enjoyed reading our fun little story. Bottom line and lesson to all-if you DO NOT have a drug problem, but experimented with a drug in the past (like most EVERYONE has, myself included) honesty is NOT the best policy in Juarez. They will get you! Beware of the psychiatrist-if you're sent to him, you're not getting a Visa. May as well split and call it a loss at that point. That is, unless you enjoy drawing pictures and writing stories for no reason other than the personal gratification and enjoyment of some deranged Licenciado out in the bad part of town. Other lesson learned-beware of the Consulate! They are STUPID and they're not afraid to show it. Mexican men have a tendency to pansy out when it comes to dealing with people of authority-don't let this happen to you! If I had been there with him, none of this would have happened. Don't be the next us!

I hate that story - it's heartbreaking. But it sounds like you have come to terms with it and are handling it very well. I pray things change soon with CIR and work out in your favor!

Lucy, fill out the supplement online. Don't go by what's in the package - the same dumbos who respond to emails put together the contents of the packet with outdated and incorrect forms and they cannot be trusted!

Wow what a story! I was wondering why you said that you had already been through this process and through CDJ, but I just didn't want to ask about it (I didn't want to sound rude or anything). Hello Chicas,

Hope everyone had a nice weekend. I just wanted to vent for a second. I read a lot of posts on immigrant2us.net. "Adriane" on there just posted her husband's experience at CDJ. I advise reading it. VERY DETAILED. Her husband had a name hit and they took all 10 fingerprints. They told him to come back at 4:00 and they already had prints back clean.

I'm pissed that they told Leo that it would be a 2 to 3 month delay to get his fingerprints back. SO FRUSTRATING. So they just decided to put our case to the side till later. REALLY SUCKS. We have no waivers to deal with either. I'm pissed.

Hi Allie

I know this won't help but if I understand it correctly, the fingerprint process for the waiver is a different process than that for a name hit like Leo got. My understanding is that for the waiver, they are looking for prior immigration violations and it appears they have the ability to check that status on site in CDJ. In Leo's case, again if I understand it correctly, it's a name hit that has to be sent to the FBI, which is the "reason" for the delay. Sorry . . . I know this doesn't help but maybe clarifies a bit assuming my information is accurate. :(

WHat can I say? What words will serve to comfort you in this difficult time? Just imagine everything getting cleared and Leo arriving at the airport and you running up to him. Just try to keep this picture in your mind. Or maybe think about everything you guys have been through, think about all those great moments you have had together. Just think that one day, ONE DAY this nightmare will all be over and you will be with Leo, this time for good, no more separations, no more crying, no more being lonely and separated. I know your day is coming, I hope it's coming very soon for you guys because you deserve it. :D

KK - Adrianne's post said he had a name hit. So who knows. Maybe his name hit was some minor offense. Maybe Leo's was for some bigger crime someone committed. All I know is that this sucks especially b/c I can't get any answers about what is going on with my case. I hope to hear from USCIS or senator's office this week. So I dont' have to deal with all the questions for THanksgiving - when is Leo getting here? I'm sure ya'll deal with that everyday too.

Thanks for responding. UCLA- Thinking about Leo and our love - keeps me going thru all this mess. Some days are just harder than others. Last week was a good week - not too much sadness - but today I'm not sad - just pissed about entire situation.

Allie - can you push the senator's office at all? If they are not getting information back to you, consider contacting another office or the other senator. During IMBRA, I dealt with both state senators and a total of 4 people (1 from one local office, 2 from another location of that same senator's office and 1 from the other senator). In the end, the 2 people who helped me the most were not from a local office, but had a good understanding of the entire K1 process and were very responsive. (1 from the local office was downright mean, the other was helpful but much too busy to respond to me). So maybe contact someone else and push for an answer. Good luck.

KK- since we just had elections - more difficult now. One senator retiring this year - and not offering any aid anymore and directing everyone to our other's senators office. I did call local office. If I don't hear something back soon - I will see about contacting senators office in Washington direct. Who knows how prompt they will be though with all the election stuff.

One thought - try one of the other state office locations of the still-working senator rather than Washington. I think that will more effective.

I agree KK, you have been a tremendous help to all of us going through this process. I hope with the knowledge I have obtained here on VJ that will enable us to be better prepared for the interview and hopefully receive the visa that day. I know nothing is for certain with CDJ, but I am certainly hoping and praying. I too want this stress over with and want to be able to live like normal people. Again thank you all for the support. I guess no one knows what we go through, except those that go through it themselves.

Thanks KK, I'm just so worried about that one incident that I had :(

I have been doing a lot of research and it does seem like the old BCC like the one I got cancelled were not visas. Ziggy also told me that per my description on how they took it from me- and the fact that they issued 2 visas for me just a month after- I shouldn't have any problem, since it doesn't seem to be a case of misrepresentation and a waiver wouldn't be needed. But I'm still really worried, specially since from what I've heard I TOTALLY agree with Heina's comment:

...beware of the Consulate! They are STUPID and they're not afraid to show it.

And BTW Heina, I can't believe your story :blink: I really admire you and Allie, I know I would be out of my mind if I had experienced what you did.

I wouldn't be a bit surprised if the Consulate decided to close that whole time between Christmas and New Years, or do what they did the day after Thanksgiving and make it an "admin" day, which means they're in there, but you're not!

Thanks Heina, we did think they may do that. But we were also thinking that since it's 4 full days left in that week, it would be kind of hard for them to close the entire time, I hope! :huh:
