HELLO TO EVERYONE!

IM NEW TO THIS MESSAGE BOARD, BUT SOME OF YOU, do KNOW ME! KITKAT, E&K, ALEJANDRA, ETC..

IM IN MEXICO CITY, MY FIANCE IS IN NY, WE JUST GOT THE APPROVAL AFTER 10 MONTHS AND WE ARE SO HAPPY. He is coming to Mexico City next week and will stay until christmas.. !

I have a 130 days overstay on a tourist visa, And reading this thread, Im a little afraid of getting the waiver.. PLEASE GOD!!!!!! NO MORE WAITING!!!!!! Hopefully I can be safe from the waiver if im under the 180 days or something like that. Any opinions?

un abrazo a todas y todos

B.

If it was under 180 days then you shouldn't need a waiver for that reason...You should be ok :)

The reason my fiance needs a waiver is because he was here illegally for more then 180 days

2010-02-08 Filed I-130 through Ca. Service center

2010-13-08 NOA 1 Received

2010-02-11 I-130 transferred to Tx. Service Center

OMG!!!! Amigas, after 8 months and 1 day: We finally got the packet from CDJ!!!!!!

My fiance sent an e-mail on Tuesday to CDJ asking if they had received the file from the NVC, and they replied yesterday saying that the processing was finalized and that we should receive the packet soon, and to our surprise we got it today in the mail!!:dance::dance::dance:

I wasn't expecting it until the end of November!!! I am shocked!!!

My fiance and I are going on a weekend trip to Penn State, and we're going to be able to give the good news to his family there!

Big congrats Emma - you are on your way and one big step closer - YAY! When do you think you'll go to your interview?

BTW, my fiance said he received his packet in the mail in Mexico a few days ago (after his interview). I thought that was pretty impressive considering the mail system in DF and the fact that he regularly does not receive his Tel Mex bill!

GOOD MORNING!!

IM GLAD TO BE HERE. E&K, THANKS FOR THE INVITATION I REALLY DID NOT KNOW U GUYS HAD THIS FORUM FOR CD JUAREZ.

I HAVE SOME QUESTIONS FOR THE EXPERTS... KK WHERE ARE YOU!?

IM STILL AFRAID OF GETTING THE WAIVER. I WAS NOT SUPPOSED TO GET THE IMBRA RFE SINCE WE FILED IN JANUARY 2006 AND WE STILL GOT IT!! SO I THINK WITH USCIS NOTHING IS GRANTED.

MY QUESTIONS, PLEASE :luv:

1. DAYS OF OVERSTAY COUNT FROM THE ENTRY DATE OR FROM THE DAY I-194 EXPIRED?

2. WHAT'S THE WAIVER FEE?

3. FINGERPRINTS ARE FOR EVERYONE OR JUST FOR WAIVERS? FEE?

4. IS THE INTERVIEW IN SPANISH?

5. X RAY IS INCLUDED IN MEDICAL EXAM? DOES IT HAVE A DIFFERENT FEE?

6. HOW MANY DAYS DO YOU RECOMMEND TO STAY IN CD JUAREZ?

7. CAN I PAY THE VISA FEE BEFORE GOING TO JUAREZ? WHILE IM STILL IN MEX CITY?

I NEED TO SAVE SOME MONEY FOR MY TRIP!!

KITKAT, IM SAD ABOUT YOU HAVE TO WAIT MORE AMIGA.. ESPERO QUE TE SEA LEVE Y QUE EL AMOR LOS MANTENGA SIEMPRE FUERTES. A MI LA ESPERA ME HA HECHO LLORAR MAS Q NUNCA EN TODA MI VIDA..

SO I UNDERSTAND WHAT TIME MEANS WHEN U ARE MILES AWAY FROM THE MAN YOU LOVE...

ANYWAY I HAVE A CRAZY HISTORY ABOUT MY OVERSTAY.. NO.. ABOUT HOW AN IMMIGRATION OFFICER TOOK MY LASSER VISA AND PASSPORT! THEN THEY GAVE ME A HEARING.. LES CONTARE PRONTO IN CASE SOMEONE IS IN A SIMILAR SITUATION.

BLESSINGS TO ALL WAITING

Hi all-

My fiance received a mysterious voice mail message in English yesterday..it was pretty much unintelligable but I could make out something about a customer delivery..it was a machine recording..he thinks it might be the packet...I doubt it because I never heard about any company calling nor have I received a packet. Does anyone know about the delivery service to the DF?

Thanks...I'm having serious anxiety waiting and wondering why they haven't sent the packet and thinking of every terrible scenario possible.

Jess, doesn't sound like it's about the packet - they send it regular mail and I really doubt anyone would call about it. You'll get it in the US before he will.

Brenda, here's the law on overstays - it will make you feel better to read it. Generally, overstay occurs if you remained in the U.S. past the expiration date on your I-94 card.

http://travel.state.gov/visa/frvi/ineligibilities/ineligibilities_1364.html

B ALIENS UNLAWFULLY PRESENT.-

(i) In general.-Any alien (other than an alien lawfully admitted for permanent residence) who-

(I) was unlawfully present in the United States for a period of more than 180 days but less than 1 year, voluntarily departed the United States (whether or not pursuant to section 244(e)) prior to the commencement of proceedings under section 235b(1) or section 240, and again seeks admission within 3 years of the date of such alien's departure or removal, or

1. DAYS OF OVERSTAY COUNT FROM THE ENTRY DATE OR FROM THE DAY I-194 EXPIRED?
I-94
2. WHAT'S THE WAIVER FEE?
$265 US
3. FINGERPRINTS ARE FOR EVERYONE OR JUST FOR WAIVERS? FEE?
I believe the full 10 fingerprints are for the waiver and cost $85. Applicants who do not need a waiver give their index fingers only, normally, and do not pay extra.
4. IS THE INTERVIEW IN SPANISH?
yes
5. X RAY IS INCLUDED IN MEDICAL EXAM? DOES IT HAVE A DIFFERENT FEE?
it is included in the exam and does not cost extra
6. HOW MANY DAYS DO YOU RECOMMEND TO STAY IN CD JUAREZ?
1 days for medical exam and pick up, 1 day for interview -- if you need to submit a waiver, you have to return on the date they tell you, two weeks later.
7. CAN I PAY THE VISA FEE BEFORE GOING TO JUAREZ? WHILE IM STILL IN MEX CITY?
yes - at Banamex and make sure you take your appointment letter and keep the receipt to show at the consulate
KITKAT, IM SAD ABOUT YOU HAVE TO WAIT MORE AMIGA..

It's ok - I'm not sad - I'm happy weare almost finished! We waited 5 1/2 months for the petition and then 2 more until his interview. I am very glad that it all behind us and now we are in the home stretch. I'll probably go for another visit soon too.

Hopes this helps Brenda!!

Hi All,

I am here in Mexico for the weekend. Spending some time with my love and getting him ready for the interview. I brought him all my paperwork and hopefully everything is there. I am in the process of taking all his clothes and personal items so that he doesn't have anything lug with him in Juarez. I am being positive and believing that he will be able to leave with me. It is good to hear from everyone and to know that we are all in the last stage of this long, nerve-wrecking journey.

Lucy - have a wonderful weekend! It's a great feeling knowing his interview is coming so soon. I always take an extra suitcase when I go to Mexico and then bring back my fiance's things - my closets are getting filled with his stuff. It's a lot easier than having him bring everything himself!

HELLO TO EVERYONE! I HOPE U GUYS HAVE A GOOD WEEKEND!

QUERIDA KIT KAT, (L)

THANK YOU SOOO MUCH FOR YOUR HELP AND FOR THE TIME YOU TAKE TO HELP THIS FORUM!

I WILL BE FREE OF NEGATIVE THOUGHTS ABOUT THE WAIVER! I HAVE 130 DIAS AFTER MI 1-94 EXPIRED.

EVERYTHING HAPPEN FOR A REASON RIGHT? 2 YEARS AGO, I HAVE BEEN TRYING TO UNDERSTAN WHY I DID WHAT I DID.. AND FINALLY TONIGHT, IT SEEMS LIKE EVERYTHING HAS SENSE..

IN 2004 I WAS ALREADY IN LOVE W MY FIANCE AND HE MOVED TO MY PLACE IN NY. YES, I WAS A TOURIST BUT I HAD DRIVERS LICENSE, CREDIT CARDS, MONEY I RECEIVED FROM FATHER IN MEXICO AND I COULD RENT AN APARTMENT, SERVICES, GET A CAR, ETC. I LIVED IN NY DURING 3 YRS TRAVELING EVERY 5 MONTHS OR SO, TO MEXICO CITY..

WHILE I WAS IN THE BIG APPLE, I WAS SO IN LOVE, THOSE WERE THE BEST MOMENTS IN MY LIFE SO I COULDN'T SEE CLEAR.. FOR THE VERY FIRST TIME AFTER 26 ENTRIES TO THE UNITED STATES, I FORGOT ABOUT THE VISA, THE 194, ABOUT OTHER RESPONSIBILITIES.. SCHOOL, EVERYTHING..

:innocent: AND ONE SUNNY DAY I TOOK MY CAMERA AND WENT ON A ROAD TRIP TO NIAGARA FALLS TO TAKE PICTURES, (IM A PHOTOGRAPHER) JUST PICTURES!! BUT IM DUMB AND I TOOK A BAD DECISSION.. I DROVE TOWARDS ONTARIO AND CROSSED THE RAINBOW BRIDGE OVER NIAGARA FALLS, DIVIDING US -NEW YORK STATE AND CANADA -ONTARIO.. YES!!! NOBODY TOLD ME SO.. I MADE IT BY MYSELF!! LOL

I CROSSED TO ONTARIO I TOOK MY SILLY PICTURES.. AND WHEN I TRIED TO ENTER THE US, OFFICERS TOOK MY VISA, PASSPORT, CREDIT CARDS, PURSE, ETC ETC! :help: I WAS DETAINED FOR 13 HRS AND FINALLY THEY LET ME RETURN TO NEW YORK CITY TO END SERVICES UNDER MAY NAME, RETURN THE APARTMENT AND LEAVE THE US IN 20 DAYS. I RETURNED TO MEXICO CITY BEFORE MY DEADLINE ACTUALLY. AND I LEFT AN ENTIRE LIFE IN NY, MY FIANCE TOO PARA QUE SE ME QUITE!! CUA CUA CUA..! I REALLY HAD A HARD TIME..

HE CAME TO MEXICO AND LIVED WITH ME THE 1ST YEAR, NOW IS IN NY BUT HE IS COMING FOR CHRISTMAS..

AND NOW, IM THINKING IF ALL THIS HAPPENED FOR A REASON, MAYBE THE REASON IS NOT TO GET

THE WAIVER!!!!!! LOL... AFTER ALL, MAYBE WAS A COSMIC FAVOR TO STAY FREE OF THE 3 OR 10 YEARS CASTIGO.. QUE OPINAN? AND I'VE LEARNED A LOT FROM THE EXPERIENCE.. I HAVE TO BE LEGAL ANYWHERE.. :luv:

KK, QUESTION: HOW MANY TIME THE WAIVER FOR UR FIANCE IS GONNA TAKE..? DID THEY TOLD HIM AT THE CONSULATE?

:P Hello again! yeah.. I dont sleep.. Im working on the evidence for the interview.. Hopefully soon!

:help: It is OK if my fiance gets me an employment letter from his work? His manager is willing to give us a letter

and the work but in the same building..

:help: I was reading what CDJ request as affidavit of support. If im using a sponsor, then the sponsor have to send only support information and no the i-134? Do I need anything notarized?

:help: Is it possible that MY FATHER, (mexican and no a USC) can be the joint sponsor?? Im a little confussed.

:star: BUENAS NOCHES!! :star:

Hi Brenda,

CDJ doesn't ask for the I-134 but you CAN have your fiance use it and it should be notarized. (I used it no problem).

The list of what they require to prove financial support is here: http://usembassy.state.gov/CiudadJuarez/wwwfof167.pdf

PETITIONER’S / APPLICANT’S OWN FUNDS

The petitioner/applicant who expects to be able to meet the public charge provisions of the law through personal financial resources may submit to the consular evidence of funds or income from one or more of the following sources:

1. Statement from a senior officer of a bank showing present balance of petitioner’s / applicant’s account, date account was opened, the number and amount of deposits and withdrawals during the past 12 months, and the average balance during the year (if there have been recent unusually large deposits, an explanation

therefore should be given);

2. Proof of ownership of property or real state, in the form of a title, deed or the equivalent, and a letter from a lawyer, banker or responsible real estate agent showing its present valuation (any mortgages or loans against the property must be stated);

3. Letter or letters verifying ownership of stocks and bonds, with present market value or expected earnings

indicated;

4. Statement from insurance company showing policies held and present cash surrender value;

5. Proof of income from business investments or other sources.

If the financial resources are derived from a source outside the United States, States, a statement as to how the funds or income are to be transferred to the U.S. must be provided.

I'm not sure how it would work for your father to be the sponsor - maybe you can post this question to the general forum and someone who knows like Aussiewench will answer!
