I suggest you call again and attempt to change your address with someone who has a clue. (If some idiot tells you again to call the embassy in DF, explain to her that you are asking about making a change that impacts USCIS in the US for your I-129F petition -- not post-petition approval or consular processing).

In addition, watch the online case status as it normally does change. RFEs have time limits so yes, if you don't respond, eventually they close the case. I wouldn't worry about this too much now.

I've lived in Aguascalientes for two years. Nice place and I've made a lot of friends and met my fiancee here. But I can't stand staying in one place for very long, especially a small place. And I don't want to be here any longer than I have to.

First understand one thing -- ONLY the consulate in Ciudad Juarez processes K1 visas. There is no other location, no other embassy, no other consulate involved. Your fiance will be traveling there for both her medical exam and her visa interview.

Second, there is absolutely NO reason for you to contact any embassy or even the consulate in Ciudad Juarez at this point. They are NOT in any way aware of your pending petition. It is first handled by USCIS in the US. It will not be sent to Ciudad Juarez until it is approved and has passed through the National Visa Center. You should read the K1 process flowchart here on VJ on well as the Fiance Visa information on the travel.state.gov site to understand each step of the process.

An RFE is not the next step in the process. It only happens if something was missing from your petition application and they request additional information/evidence. You would see on this on the online case status update, but you're correct that you would not know what they have sent you an RFE for until you receive the physical RFE in the mail. I believe you have 80-some days to respond. Since you are worried about not receiving mail in Mexico, it makes sense for you to call the USCIS misinformation line and attempt again to change your address. Before you do that, you need to clearly understand that if some idiot at USCIS tells you to contact the embassy, you need to tell them that that suggestion makes NO sense when your petition is in the US. If you have to call two or three or four times before you get someone who actually has a clue regarding how to do this correctly, so be it. You can also check the USCIS website to see if there is anyway for you to change your address online.

Thanks again for the response. I'll try calling again when I can find a phone again. I have my doubts calling them again will do me much good other than cost me more pesos I don't have. But I really need to try everything. The USCIS lady who spoke with me checked with some other people before we finally hung up. She tried changing the address via her computer, figured out she couldn't, put me on hold to go talk to others, and then came back and said it's impossible for them to change a Mexican address from the USA, and that I'd have to contact the Department of Homeland Security location in Mexico, which turned out to be this embassy in Cuauhtemoc. No, I can't make an address change online since it requires that my previous address have a USA zip code.

I understand the RFE will only be sent if there are some issues with my request, and that the RFE would be sent before they could issue an NOA2 and send anything on. I've looked at other people's charts in the K1 process and many of them have RFE's listed after the NOA1. I hope nothing goes wrong with mine. I followed everything it said on this site but that's no guarantee.

Right - there's no guarantee that you didn't forget something or that they didn't lose something or that they won't want more information. Therefore you need to do everything possible to get your addressed changed. And it appears the only way to do that is call again and get someone who actually has a brain (which may not be easy). It doesn't matter how many people she talked to - the idea of contacting a US embassy in Mexico to change an address in reference to a petition that they have no involvement in makes no sense. DHS is not involved in your USCIS submitted petition. I doubt they would know what to do. Then again, try contacting them and see if they can help you. You need to get your addressed changed and you need to do whatever it takes to get it done.

Packet 3 Arrived Today!!! ALL RIGHT ALL RIGHT!!!! Literally 4 months to the day since we started this whole process.

The plan now is to fly to Juarez on Sunday, she gets her medical done Monday, and goes for the interview on Tuesday.

I'm putting together and organizing all the evidence as well as finishing the paperwork. I'll post my comprehensive list for all to review just to make sure I'm not forgetting something.

I got a notarized letter from my bank worded as such:

To Whom It May Concern:

This letter is being written in honor of a request submitted to our institution by our client <MY NAME>. The accounts that he holds with us have been opened since <DATE>, and has been in good standing with us throughout the client relationship. In addition to this for the year of 2006 there was an excess of $xx,xxx.00 deposited into his primary checking account, and has current balance of $xx,xxx.xx. If you have any questions please contact <bank name> at <bank phone>. Thank you

Now it meets the I-134 form (which I know isn't required by CDJ, but I included for simplicity) requirements for bank statement, but its missing 2 of the 4 items that CDJ said it should include:

1) Present Balance (yes)

2) Date Account Opened (yes)

3) Number and Amount of Deposits/Withdrawals during the past 12 months (NO)

4) Average Balance during the year (NO)

My big bank (US BANK), said while they have a list of all deposits/withdrawals they don't have a "quick summary screen" with that information. To get that would have to be manually done which he said would be a major undertaking due to the activity of my account...then he asked why I need that when the government can easily find this out themselves...i chuckled.

Under the "Petitioner's Own Funds" section of the CDJ guideline for "EVIDENCE, WHICH MAY BE PRESENTED TO MEET THE PUBLIC CHARGE PRIVISIONS OF THE

LAW.", I am submitting 2 other items in addition to the bank statement: 1) Ownership of Property and 2) Stocks (401k statement).

Given the equity values of the other 2 are OK and i have a nice job that the salary shouldn't be an issue, how important is it that the bank statement contain ALL the information they want vs. the information the bank provided in their letter?

I know it would be best to have ALL the bank information, but I'm not sure how willing the bank would be to do this and don't feel like getting into a argument of customer service right now :)

So my point is, how big of a deal is it if those 2 pieces of information are missing from the banker's letter? Any experiences? Thanks!

Don't worry about it - it sounds like you have more than enough. I think if you tax return shows about the minimum poverty guidelines, they probably don't even look at the other stuff!

I know you meet the income requirements, so I think you more than have it covered! I'm so jealous that you're already going! I wish I could be there too. Good luck!

Thanks for the replies. I just wasn't sure how picky they will be.

I leave Saturday morning!! I'm flying into El Paso and plan on taking a cab to the Juarez airport where she will be flying in. We will be staying at the "Lucerna" hotel until Wednesday.

So the plan is Monday morning at 8am (is that too late/early?) she will go for her medical at the "Clinica Medica Internacional". After the medical, go get pictures taken at the place right in front of the medical clinic then off to Banamex. Then go back at 2pm to hopefully pickup the medical packet

Tuesday at 7am I'll accompany her to the consulate with all 100000 pages of forms/evidence. When it's time for her to enter the consulate (and I can't), ummm...i guess i'll go get drunk or think of something.

Any other words of wisdom or ideas??????? Anyone else going to be there when I am????

When my wife went to her interview all they needed was my tax return and W2. I made way over the minimum so they told her that was all they needed. I am all for providing more information than is needed but don't worry about other income information if you dont have it as long as you show that you can easily support your spouse.

If you have time ask someone how to get to Viva Mexico and see the show. It is a restaurant but at night it is a dinner theator. They sing and dance, and a little comedy too. It isn't too expensive and you will have fun.
