That's what the marriage certificate is for, which is the ONLY document that AOS requires as proof of marriage. :bonk:

If they were going to be approved without interview they might be issued an RFE to documentation.

Not for things like wedding pictures or joint accounts.

The AOS guides mention nothing like proof of relationship for the initial filing. Yes, it's brought to the interview if there is one, but those that get approved without interview don't receive an RFE for it.

A marriage certificate is all that's required.

I think the guide is like people are trying to read the recipe for a cake, and they end up mixing the cake dough and topping together and realize later on that it was 2 different stages.

Anyways, BOTH the K1 petition and AOS have a similar structure. The first package asks for initial evidence of a relationship/bond between you to be eligible. With the K1, it's having met(passport stamp, eg). With AOS, it's taking it one step further and being married(marriage certificate). Ongoing relationship is asked for at the interviews(if there are interviews, and if they ask). Ongoing relationship is just more comitting when being married, and in the US.

2/16: Text from USCIS that Baltimore has scheduled an interview...finally!!

2/24: Interview letter received

3/24: Naturalization interview

Timeline

If they requested them, I would send it as requested and save a copy for the interview. The only thing we did not send was recent joint stuff since the application and more photos. All new stuff was taken to the interview.

We didn't include anything beyond the marriage certificate as proof. Approved with no problems. There is enough to worry about in this process. You can drive yourself crazy with worry. Try to just enjoy life and deal with the problems at they come. Most of the time, what you you worry about never happens, so why worry?

I think some people are confused because AOS from any visa but K-1 or K-3 requires proof when sent. K visa holders do not have to send proof because their relationship was vetted before they got their K visa. If USCIS wants more they will send an RFE or, more likely, send you for an interview where evidence is required.

Have a question. What if one is un able to respond to rfe based on K-1. Can he apply again for aos or should start all over again or should apply for I-130 with I-485?

If you don't reply, you'll be denied at some point. EAD and AP are then invalid. You'd now be in the country without authorization and could be removed. If you're married to a citizen, you could apply for a waiver on any ban. I don't think anyone is going to come chasing you down to remove you, and I've seen mention of re-applying. But why would you let it get to this point? You loose the $1070 fee you paid. Is they're some information you're waiting on? I'd make an infopass appointment and see if you could get more time to reply to the RFE rather than let the application go to a denial.
