Hi my vj fellows!!!!! Im just freaking out! I sent my AoS (Im k1 visa holder) package yesterday and my husband and I checked it like thousand time, following the visajourney guide (step by step guide).We Followed the instruction and we checked the list of items. The point is that we didn't send any bonafide marriage proof (wedding pics, letters, joint accounts etc) cause IT WAS NOT in the list...I was checking here, and some people sent this kind of proof with their AoS package. We are worried! A lot of getting a RFE or a denial.

Some advices pleaseeee!!

Those items aren't sent with the forms, those would be needed at an interview if you guys have an interview, some people do, some people don't. If you read all the AOS guide and filled your forms correctly you should be fine. Good luck :)

Why would they get an RFE for things like joint accounts, wedding pics, etc?

If they were going to be approved without interview they might be issued an RFE to documentation.

We had an interview and were approved.

The interviewer asked what we had.

He already had the joint 2011 tax return. The only additional item he actually saw was one bank statement with both names.

I don't think K1 visa holder needs to include proof of bonafide relationship

A marriage certificate is enough'

If they don't believe your relationship is bonafide, they wouldn't even issued the K1 visa

Proof of bonafide relationship is for people who filing the I-130 form which is like I129 for you guys'

As you are AOSing from a K1, proof of relationship IS NOT required (I sent none). The only requirement is of course the wedding certificate to prove you are married. I, and several others (I'd be willing to be thousands) did the same thing and were approved no problem. I personally was approved without interview or RFE in less than 3 months (back when it was only taking 3 months that is).

Do not stress. If you are RFE'd (which can happen, I won't lie) then send in your evidence. It is not something you will be denied for not sending, again, because it is NOT a requirement for someone AOSing from a K1.

Because clearly they want to see proof of the couple being married.

Um no. AOS from a K1 DOES NOT require relationship proof except for the marriage cert. If they want relationship proof (maybe there wasn't enough from the K1, or they're from a high fraud country, or there's a red flag) they will either RFE or interview.

To Add From the AOS Guide:

Interview (in person) for Adjustment of Status

Eventually most people (see exception below) will receive a letter from the CIS informing you of your interview date. It will include instructions on what to bring to the interview and any required items you may need to complete before hand. One of the most critical items requested will be "evidence of the relationship" which proves that your marriage is true and faithful (i.e. photos, joint checking account, joint lease, joint mortgage, and birth certificates of children if any, etc.). Also, it is important to bring the current passport of the beneficiary to the interview. The interview is fairly painless and may be video recorded and lasts between 15-30 minutes. If approved you will be mailed your "green-card" shortly after the interview date (weeks).

Interview Exception. In some cases a beneficiary's Adjustment of Status case may be transfered to the California Service Center (possibly another location) where the CIS will attempt to complete processing without requirinig an "in person" interview. There is no particular way to know if this will happen to your case however if this does happen then you will not be required to attend an interview in person. If the I-485 is approved the beneficiary's green card will simply be mailed to them.
