Hi guys,

I was on F1 visa and doing an AOS to GC. I got married on April 2012.

I submitted my documents and got an RFE. My husband doesn't meet the income requirements so we need a co-sponsor.

My father-in-law is willing to do it. My question is what forms do we need to submit along with my father-in-law's form i864?

Does my husband need to submit i864 too? Do we need to fill out the Contract with a household member form? We do not live with them and we pay our own apartment.

My husband works now but is trying to get back in school.

Any help is appreciated. Thank you!

Did your husband already submit an I-864 with supporting evidence? If so then he doesn't need to submit another one. If not, then yes - absolutely. He's the primary sponsor and an affidavit of support is required from him, regardless of whether or not he meets the income requirements.

Your father in-law will submit a signed I-864, a copy of his most recent tax return or IRS transcript of that return, and proof that he's a US citizen or permanent resident who is domiciled in the United States. He should also submit a letter from his employer confirming his employment and salary, and some recent pay stubs to verify current income. He can't submit an I-864A - contract with a household member - because he's not a qualified member of your husband's household.

05/01/2013 - Removal of Conditions - APPROVED!
