After three weeks of receiving RFE. There is no ouch on my case. I was told it is on hold waiting for back ground check.

Is There any hope that if your name is hit some kind of records and wait for clearance?

my fiancee was pregnant. I am thinking to give up the k1 and married then k3.

Is there any good lawyer there can help me?

I send request for my name record to FBI based. No sure if they will responded.

Please give share your thought.

Response after RFE can take some time. If you know are in background checks, the same thing would happen for a K3 I assume. There is nothing to gain by paying an attorney - he cannot do anything to move your case or get information. An FBI record check usually takes several months (3-4). You could contact your state senator to ask them to make an official inquiry into your case and perhaps get some additional information for you.

This is just my logic and it may be off a bit but...

If your getting caught in name-checks for the K-1, you'll likely get caught in them again for the K-3. You'll likely have to get right back in the begining of the line for getting things approved and it may take even longer.

I also don't see how a lawyer can help in this case. It just seems like a hole to throw money down before sitting on your rear waiting again.

...And the Senator's office can make an enquiry and come back with the same answer: They are waiting for name checks. If the enquiry is made close to the name checks being complete, your case will move forward soon after the enquiry. If the enquiry is made at the same time as the name checks are complete, you may be delayed temporarily while the enquiry is responded to.

One thing is if you are in security checks no one can help to expedite your case. Secondly only a congressman can inquire about the status and in our case he got the same canned response when we were in AP and ours lasted for 5 months. It all had to do with the country my husband was coming from. And name and security checks are considered a matter of national security since 9/11.

Secondly, a member on this board filed a K3 and CR1 and her husband interviewed for the K3 and the case was put on AR. This lasted almost one year. She was interviewed in US by the local office and was told they would not get the K3 but he would be entitled to the CR1. Problem was that the checks started on the K3 and could not be completed in a short time and they could not run the name checks on the CR1 since the K3 was open. Now the K3 name checks finished the embassy sent the K3 paperwork back to her husband. She is now in over 100 days of name checks again for the CR1 and ongoing as of this date. Name checks have a short life span and you cannot transfer the data from one check to another visa.

Are you sure that the FBI is involved? The one check that I am aware of during processing of an I-129f petition - be it for fiance(e) or spouse - is IBIS. I know that CIS makes the IBIS check themself, I don't know if CIS also clears any 'hits' or if they have to rely on some other agency, such as the FBI, to clear the 'hits'.

Attorneys have lines of communication with CIS that are not available to the public, as do Senators and Congressmen. Some attornies are responsive and have staff that knows what they're doing, others not. Same for Senators and Congressmen.

So much for the similarities, now for some differences. Attornies cost money, Senators and Congressmen do not. Attornies bring a different kind of pressure to bear than do Senators and Congressmen, if pressure is called for.

Based on what you have reported, it is not apparent that you need the assistance of either type as yet.
