Hello everyone

my name is Heike and I am german and have 2 kids age 15 and 16 years old , I am married with a US Citizen since may25.2012 he is based in germany. I do have a lot problems to get my visa to move with my husband to the states. I am not command sponsored because the time was to short my husband get out of the army end of august and move back to states because of his NG he signed for.

I also know that my husband is this time my sponsor and i do not have another sponsor

Is there a way that I could go to the states with my husband i do know that i can stay there for 90 days with him and make the visa in the states or is that not possible I dont want to be illegal in the states but it is very hard to be stuck in germany and nobody knows for how long

would be nice if there is someone on here who can answer me my question

Hi Heike,

there are many people in the same (or similiar) situation you are in. The best solution would have been to do CR-1 but with DCF right after you got married. Since your husband is going back to the States soon, I don't know if that is still an option.

The normal route would be to apply for CR-1 by sending the I-130 petition to USCIS in the US and everything that follows the approval (I don't know how much you already read, let me know if you need more details). We started the whole process in February and I hope to get an interview date in the next 2 months. Just to give you an idea of the time frame.

Going to the US with the intent to stay there (without the appropiate visa) is visa fraud and could result in you being banned from the US.

I know that it seems so confusing at first but with a little research, it's not that difficult to understand anymore.

You don't wanna come to the US on a tourist visa with the intend to stay. This

could get you an at least 10 year ban. I'm not too familiar with army visa

processing times. But it looks like as if you just have to sit this out. Don't

worry, they are usually pretty fast. Good luck on your journey.
