I am a Canadian who has been working in Canada as a Tooling Sales Enginnering Technician for the last 9 yrs for an americian Company Independantly.

I am basically a Independant Billed contract worker

There is an opening for a postion in the USA for this company that requires my skills and knowledge base

And they are petitioning me for a TN Status Visa

I actually am applying under the Technician Class..

Now i went to the border today to get the TN Visa and I was Refused because i dont have a degree.

I explained to the agent that its under the Technician Class and my yrs of experiance is equilent to a degree but he

didnt see it that way

My question is for a Technician Position that works in direct support of a Enginnering Discipline

Do i need a Engineering Degree to Qualify for a TN VIsa or Can 9 yrs of Experiance Qualify enough for the position ?

I want to go back to the point of entry and reapply again and get the TN Visa

Technician or Technologist, Scientific.

(E.g.: Electronic engineering technician.) Must:

work in direct support of professionals in one of these disciplines:

biology

chemistry

engineering

forestry

geology

geophysics

meteorology

physics

possess theoretical knowledge of discipline, and

solve practical problems in discipline, or apply principles of the discipline to basic or applied research

How temporary is this position?

You would need 12 years to be equivalent to a degree.

It would need to be relevant and documented to be used in place of a degree, if needed.

3 years does not sound very temporary.

I do not know that much about TN's, hopefully the Company Lawyer does. A phone call seems in order.

I actually have 17 yrs total experiance,

and the offer is just under 3yrs

Start Aug 2012 and Concludes July 2015

What does your lawyer say?

Okay discussed with the lawyer this afternoon

Basically was told that there is only 2 classes that qualify for a non degree tn

1.Sci Tech

2.Management Consultation

The Sci Tech is basically what i qualify with my Technical background and job description

but i was told that as of 1 yr ago this change to where Border agents stopped issuing without degrees

and now are starting to require degrees

Is this correct?

the management consutlant title would basically put me into a Contracted Consultant Role and i could not be

an employee

which is really what i dont want...

So my question now is

Should I re apply at a border for a TN Visa under the Sci Tech Title

and if so do i need a Degree for a Sci Tech Role

The Consultant role I know has been abused so is very carefully checked.

yes Up to 3yrs

but was told to go for 2yrs

Did the requirment change for a Technician everything i am reading says Acedemics not Required...
